Little update: Filed i130 on June 20, 2024 online Filed i485 package with i864 in it on July 22nd,2024 via UPS July 24th, 2024 - USCIS added the case to my mother’s account and scanned some of the documents from that package that we sent July 25th, 2024 - biometric reuse notice appeared under the Documents tab August 2nd, 2024 - RFE sent: they want Medical exam i 693 and they want that I fix some mistakes I made on 864 form. August 28th, 2024 - we responded to RFE and sent a new package with all the docs they wanted Sept 9th, 2024 - Notice appeared in the online USCIS account that they received the RFE response and started reviewing the case again …to be continued…

  3. Hello all, I read through the forum but could not find a topic for June 2024 filers of i130 for parents of USC. My mother is in the USA, she has humanitarian parole and TPS as well. I filed i130 online on June 20th, 2024.
  4. It is simple, you can file i130 online. They guide you through, by asking to answer the questions and then to add the documents. 1.For the birth certificate, it asks for yours to establish that she is indeed your mother. her name and last name should be written in your birth certificate. You should upload the original and the certified translation of the Birth certificate from Spanish to English. Notarized is not a requirement but many lawyers advise to have the notarized translation. 2. Yes, correct, you should chose consular processing abroad. 3. I am sure there should be plenty of You tube videos of how to fill the i130 form out 4. All they ask about the father is his name and date of birth. 5. I think you can do it without the lawyer
  5. Yes, Thank you! I got my certificate! So happy! The ceremony was very formal and quick, like all in NYC, busy-busy. I think, they were having one ceremony every hour that day, LOL
  6. Just upload what they are asking for. The online form designed the way that it adopts to the person filing it by tailoring the experience based on your answers. as for the birth certificates and marriage/divorce documents, I uploaded them under proofs of name change (or something like that) section. I am a US citizen filing i130 for my mother.
  7. Hello all! I had my interview today at 10:30 am in NYC at 26 Federal Plaza. I arrived 45 minutes early, because I was nervous and I don’t trust morning train traffic😏 I went through the security check downstairs, went up to the 9th floor according to my invitation letter, and checked in there but had to go back to 4th floor for the interview. So I was glad that I had arrived before the actual appointment time. There were about 25 other people already in the waiting room, and I went to the window and checked in again (gave them the green paper that I received from the 9th floor). Then I waited in there for about half an hour. I brought my flashcards with civic test questions and was reviewing them while I waited. Then I got called at about 10:35am. My officer was a very serious African-American lady and she would not smile or have any small talk with me. First she had me swear to say the truth and took my fingerprints, then she asked me for my passport, id and a green card. Then she asked me civic test questions, I remember just these: Two National holidays? How many voting members in the House of Representatives? WHo is the governor of your state? Why there are 13 stripes on a flag? What is the one freedom from the First amendment? And then she asked me to read the sentence from the tablet: When is the Thanksgiving day? And to write with my finger on a tablet: Thanksgiving is in November. After that she reviewed my whole immigration history. She was asking how I became a permanent resident. She asked if I work and where, and where and when I worked previously (for the last 3 years) and where I went to school within these 3 years. She asked me where I lived and when and where we lived together with my ex husband. She asked if I am still married, and I said that yes and that I am in the process of divorce and could not do it earlier because of financial hardship, and she said that that is understandable. She asked about my travel abroad and for how many days I was there. At the end she asked me to verify my current address and a phone number, and how I understand the Oath of allegiance. Then there were those “No” questions and some of the “Yes” questions. I seem to answer every question okay. At the end she made me sign biographic info on the tablet and then the oath of allegiance on a tablet. Then she said that she will recommend my case for approval, and that I will get an Oath ceremony invitation in mail. After that she smiled finally! 😄 For the documents, I brought 4 huge binders with me, taxes for last 4 years, my previous approved petitions, and more stuff, that was absolutely not needed, because all she asked me was my passport, my id, and my green card. In about an hour my case status changed to Oath invitation was mailed, and I saw a document online: It is scheduled for June 13th, at 2 pm! I can’t believe it is over, I am so happy!   8. Hello, I got my inteview scheduled for May 29 in NYC. I am applying under VAWA after 3 years, now this interview invitation letter mentions that if applying through USC marriage I need to bring his original birth certificate. I have not communicated to him since 2018, and obviously I don’t want to do it. All I have is a copy of his birth certificate. What should I do about this requirement? Anyone had their interview after vawa?

Hey all, I was writing earlier that I applied on February 22nd, in NYC, under 3 year rule and after vawa approved, and did not get any Bio reuse notice, so guess what, 2 days ago the status of the case changed to Actively reviewed by USCIS. And today I just logged in to my Uscis account and checked the Notices, and noticed the Biometrics reuse notice! So, now my timeline is as follows: February 22nd - filed N400 online in NYC, receipt notice right away February 29th - Case status changed to “Case is being actively reviewed by USCIS” February 29th - Notice of Biometrics reuse appeared under Notices tab
  11. Hello, I filed online on Feb 22nd, 2024. I am in NYC, filing under 3 year eligibility but after approved vawa case. Online form seemed very easy and they only asked to add my greencard and my marriage certificate (since I am still married to USC, in divorce process now). That was all they asked to submit. And it felt kind of not right or something, almost got me anxious. I added approved vawa petition just in case. I did not get a notice about the Biometrics reuse, unfortunately. Is this a warning sign?
  12. I just applied with the same background. I just followed the instructions I found on NOLO website. I picked “Other” and wrote an explanation “Have been an LPR for at least three years (VAWA, I.N.A § 319(a))." In the evidence after the form I added this memorandum I.N.A 319 (a) which I found downloadable through Google search. I hope in helps you
  13. And this is true. I am ready to explain if asked. Life did not treat me well these years either. The whole thing gave me some serious health issues that I had to take care first. Also, I was in school during that time and finished school with my credit cards maxed out. Not to mention Covid pandemic when I lost my income for 7 months. I just got on my feet, I would say last year more or less, so that is when I started thinking that I need to get the divorce at least started (I know it can last long months if not more to get finalized)

So how come you are saying that it is a requirement, but then you post the acceptable grounds for No fault divorce and there it is: Irretrievable breakdown of the marriage for period of 6 months. I am confused. and Yes, this is what I wanted, an No fault grounds, and, as for the attorney, No, she asked for 5K knowing that I am asking for uncontested/No fault divorce. I did not even mention to her that I had a Vawa case, she does not need to know that. All I asked her for is Uncontested divorce at No fault/Irretrievable breakdown of the relationship for 6 months and possibly help locating my spouse at current time, which I even offered to give her 3 addresses where he could potentially be living (last known address and his relatives addresses).
