  1. I recommend joining your AOS Filing month forum on VJ so you can discuss and receive help from your filing group peers.
  2. And you've EMAILED the PP and showed them the REQUIREMENT that they MUST provide you with a copy AND you've threatened to report them to the CDC and showed them on that same page how you ycan do that easily? And they still refuse to give you one? You've gotta stand up for yourself here. No. That's irrelevant. If you read the paragraph above what I quoted you, you'll see that.
  3. " Both the panel physician and the applicant should be aware that the DS-3025 is the applicant’s vaccination record, and an extra copy must be provided to the applicant. The applicant will need to provide a copy of the DS-3025 to healthcare providers, schools, and other institutions after US arrival." https://www.cdc.gov/immigrantrefugeehealth/panel-physicians/vaccinations.html
  4. Of course, that was a requirement however they are also required to give the patient their own photocopy. They are bound by the agreement that considers them panel physicians through the CDC to provide one. You can email or call the PP and remind them of that requirement or you can even show them a copy of the requirement through email on the CDC website if they play stupid. No. Don't do that. At worst, do nothing and wait for your interview or RFE. You are not required to provide an I693 as a K1 and you are definitely not required to submit it with your I485 for ANY adjustment class. Ensure you read the I693 instructions to see what I'm talking about.
  5. Sure. They pressed the wrong button. Or they gave you one for forgetting to submit a doc and then later found the document because your docs were out of order compared to the order you listed on your coverletter. Lots of normal reasons. RFEs come by mail within 30 days. Read it when or if it comes.
  6. If you are following the instructions like you should, all. Need to? No. Can you? If you perhaps have something, sure. Need to? No. Highly recommended to? Absolu-+×#*- lutely. Its free. Why would you not and risk an emergency? Same with I765. They are a recommended package.
  7. *the US petitioning sponsor is "filling out" the I864 form for themselves in support of the foreign applicant's I485. They are the sponsor so the form is largely about them. The immigrant is the immigrant. Their info goes in those sections. Fill it out as if you were the sponsor.
  8. Only the applicant needs to go. She should do hair and make up if she wants to as that photo will likely appear on every immigration card she gets until she becomes a citizen. You walk in door. Sometimes security checks your notice for date and time. Go through security. Wait in line to check in. Give them notice and ID that matches the name on notice. They fill out a form, hand it to you with number and stamp your notice. You go sit and walt. They call your number. You hand in form. Keep stamped notice. You go up to booth and they take your fingerprints with a digital scanner. Then your photo. That's it.
  9. There should be no debate. Only those applicants who do not fall under public charge are eligible to state no.
  10. Medical should be completed once interview appointment is scheduled. Why? I693 is valid for only 2 years. Interviews can take much longer than that. Ensure you've read the I693 instructions. Current income is the amount of PROJECTED income that you WILL make in 2023. It is the amount that is listed on your employment verification letter that your employer wrote up for you to submit with your I864 and is backed up by 6 months worth of current paystubs. Current income has nothing to do with taxes or tax documents as taxes prove PAST not FUTURE. Tax return transcript OR (NOT AND) COMPLETE federal tax forms copy including all pages and schedules AND earnings statements for 2022 is required because 2022 is the current tax year until April 2024. 2021 and 2020 tax transcripts OR forms are OPTIONAL but you must still enter the AMOUNTS of your Gross Total Income in Questions 24 a,b,c. Again TAXES prove past income not future. Ensure you are reading the instructions. There is a 90% chance you will get an RFE if you don't read and don't understand how to fill it out and what documents to provide. EXACT, SPECIFIC documents for YOUR individual financial situation are required. Not a bunch of miscellaneous ones that don't show them what YOU need to prove for YOURSELF. Wrong ones = RFE. Less is more. Yes. Input what you are trying to prove on the I864. They should match, right? You should follow the USCIS form filing tips. You should also read all instructions for all forms. You should also read the VJ guides. You should also join your VJ AOS Filing month forum so you can ask these questions to your peers. You should also fill out your VJ timeline as the reciprocal request of being a member.
  11. Honestly, I'd do some more research than that. RFEs are very common but very simple if you know what you are doing. You had to send the complete federal tax return incl all pages and schedules AND earnings statements (if employed and not self employed) OR just a 4 page return transcript (if employed and not self employed). Don't get me started about submitting a regular monthly bank statement. That's not the type of bank document to provide for assets at all. Use the search bar "I864 RFE" and learn what you need for your situation.
  12. Mail only. Another RFE or NOID. Yes. All concurrently filed cases are paused while RFE is responded to and fulfilled.
  13. Current income is paramount. Tax reported income is secondary. Total situation will be considered. Well, you forgot the W2s so that would be likely one of the errors. Tax return must be all pages and schedules of federal return. More/ different if self employed. (You should have submitted a transcript instead and W2s would have been needed). Ensure that your EVL is the correct format and on business letterhead and that you've provided 6 months worth of paystubs if you are providing paystubs (recommended). There could be errors elsewhere though including on the I864. That is more common than anything. The RFE is always generic. Without being able to look at your forms and evidence, your best bet would be to scour through similar posts where posters have gone into detail and have been answered. There are many, many "I864 RFE" posts.
  14. You'll have to understand the process then. I485 is submitted to a LOCKBOX based on location of residency (by state). K1 I485s are sent to the NBC for preprocessing and then to your LOCAL FIELD OFFICE (which is based on your zipcode) to wait for an interview. I485s are not filed at Service Centers. They are filed at Lockboxes. K1 I485s are all preprocessed at the same SC (NBC). K1 I485 timelines are based only on your local field office timelines not the lockbox you had to send it to because of the state you live in. Knowing the fastest local field office is irrelevant as: 1. Your case cannot be processed there unless you live in the zipcode that that LFO services. 2. Timelines fluctuate CONSTANTLY meaning from month to month so while one month it may be a fast LFO, the next it may be the slowest due to for example, an influx of immigrants to that community. WHY are you asking so we can help understand how to answer your question further?
  15. Your Service Center is irrelevant. I485 timelines are based on your individual local field office wait time estimates. You can look up and monitor yours for any changes to the estimated wait on the website. What website? The same one you monitored for your I129F approval.
  16. Each state is different. In many states, a K1 cannot drive past day 90. That's just one of the fall backs of a K1. If needing to drive, a Spousal visa would have been a better option. If you applied for I765, once that is approved (if approved before your GC approval) you can apply again. Until then, you enjoy your time off.
  17. As above, she is your mother AND lives with you, so she qualifies to be YOUR CO-sponsor. She will not qualify to be a joint sponsor for those reasons so if you mistakenly fill out an I864 and they see she is your mother and living at your address, you'll get another RFE. JS=I864 CS=I864a Verification of benefits letter. Again, assets are ONLY used IF your income doesn't meet the guidelines. You are not padding. You are meeting only. If she can prove her individual income PLUS* yours meets the poverty guidelines, then your dad doesn't have to have anything to do with this. Does she have proof of her individual income? Can you dad provide for himself? I always recommend in these cases that the non-sponsoring spouse who is jointly included on the ITR of a sponsoring spouse provide their own proof of income to show that they are independent and of course, explained as such in the additional information section of the original I864 as to WHY you are submitting such document. I always recommend EVERYTHING that could be concluded as confusing or as to why you are submitting something that isnt required is explained in the additional information section. If you don't follow instructions or submit something useless and don't explain it, you can good as well expect them to not accept your I864 entirely because you sent them a bunch of useless documents that prove nothing. They aren't going to figure, interpret or exponentiate anything for you. (*PLUS because co-sponsors are eligible to ADD their income to original sponsors income on their I864. JOINT Sponsors cannot. JSs have their own household).
  18. Refers to self employed employees who often use the wrong box on their ITR.
  19. You would think but they want it spelled out. Start date. Estimated salary or earnings for current year (2023). On official letter head.
  20. Proof of current income can be shown with an employment verification letter and BACKED UP with 6 months worth of current paystubs (no less, ensure you are following the instructions which DO STATE 6 months worth). Paystubs alone are secondary. EVL is primary. Did you NEED to use ASSETS (bank statements) because your current income didn't meet the guidelines? If you didn't that's likely ONE of your issues (of many) as the are looking for an official written STATEMENT from your bank divulging your lowest balance within 1 year, not monthly bank statements. Also the amount you input as assets from your monthly bank statement is incorrect therefore voiding your I864 entirely because you used the wrong asset proof (statement from the bank not monthly bank statements). If you dont need to use assets, don't. Why because you have a greater chance to provide the wrong proof. Less is more.
  21. Then you have your answer in the I751 instructions on page 1. Please be sure of your visa type when posting and ensure your VJ timeline is always updated (it is not as of now if your K1 filed I751 already). VJ even made a emoji to remind you that as a member, your timeline needs to be filled out to be helped efficiently. Please edit.
  22. For those adjusting in the US. That is not the case for the OP. Correct. They would be denied immigrant visa pending a waiver approval which could take months.
