Lots of members is an understatement. I864 is the most commonly misfiled form out of everything I've seen. I'd say there is a 50% success rate tbh. Mentioning what you sent or a copy of your coverletter showing what you sent with your I864 will be helpful. RFEs are not sent for no reason and although generic, sending everything that you already sent won't solve your problem. 6 month of paystubs are the recommended dose WHEN YOU submit a current Employment Verification Letter AND use the amount listed on it as your current income. Did you submit one AND use that amount? Employment statements (W2s) are REQUIRED if you submit a COMPLETE copy of your federal tax return (all pages and schedules) but SHOULD NOT be submitted if you submitted a Return Transcript INSTEAD. Highly doubtful. It's never sent for no reason. There is something wrong with your form and/or HOW you filled it out and/or the documents you provided. As above, RFEs are generic. Everyone gets the same one. It lists all of the possible errors for everyone. Doesn't mean you made all of them but you did AT LEAST make one of them so they cannot proceed any further. Lots of threads on the topic to research. Search under "I864 RFE." Then pull out your paper work and deduce your error(s).

I'm sorry, I can't offer specifics other than an RFE of this type could mean a lot was missed and as I can't see your documents nor do I know anything about your individual financial situations, it wouldn't be fair to guess. Like I said though....LOTS of threads on the topic to read through and determine what you need to do. I will say, less is more. Assets only if income doesn't meet guidelines. Never as an extra.

Rfes are generic. They don't pertain to your individual situation ever. "I864 RFE" in the search bar will be a good research tool for you to read through the many reasons why I864s are filled out wrong/incorrect documents and how to remedy it. It's nearly an impossible task to remedy without scouring the paperwork in person and comparing to all of the possible errors.

2 yrs to 10 yrs green card timing
K1visaHopeful replied to AD1's topic in Removing Conditions on Residency General Discussion
2 years minus 90 days from the 2 yr card expiry. So the actual date in 04/2025 minus 90 days. Not a day before that. I751 ROC -
LFO is determined by zipcode not location. Did you look yours up on the Field Office Locator website to confirm? Interview is 50/50 chance. Maybe. Can't say for sure without looking at it. Maybe but that's doubtful. No. Unless you didn't get a GC now. As above, interview is 50/50. With an approved GC? No. You are a CPR. If it's a GC, yes. If it's a GC, yes.

Pardon? The K1 would need their own I485 and their own I864. Each K2 would need their own I485 and their own I864. The answers on the K1's I864 would NOT be the same as the answers on the K2's I864 ESPECIALLY for the question at hand. Is that what you are saying?? That you filed out all of the I864's THE SAME? Or are you saying you submitted only ONE I485 and ONE I864 for EVERYONE? Please be clear in your explanation and details and confirm HOW MANY immigrants you are asking about and HOW MANY K1s and K2s there are and what you filled out for each person. You likely have a way bigger problem than you think.

June 2023 - AOS Filers
K1visaHopeful replied to Sarge2155's topic in Adjustment of Status Case Filing and Progress Reports
Making it clear further: The immigrant APPLYING for AOS can only expedite their OWN AOS application by enlisting in the military THEMSELVES. The AOS spouse and sponsor being in the military is irrelevant. -

I kindly checked the website for you. Your estinated wait at this moment in DC is 17 months and you applied 4 months ago. You have a long way to go before eligible to initiate an outside of normal processing times enquiry. You likely recieved an RFIE and not an RFE which means they couldnt even begin to look at your application because you didnt submit the minimum required. Doesn't mean now that they have the minimum that they WILL process. Just that they CAN. I suggest you learn how to use the website and monitor it often for estimate changes. I also suggest you read up on the process by scrolling through previous AOS Filing months. -

As explained, your status may never change to RFE/NOID/Approval. No. You cannot expedite I485 unless you join the military. Your estimated wait at your LFO as listed on the USCIS processing times website that everyone follows is what? If you haven't passed that timeline your worry/excitement/urge to do anything is preemptive. -

Not sure what you're saying? If your status has changed to "RFE response received" that's the only status update you'll get. You may or may not ever get a status update. Ie. I've had my GC since 2019 and status is still case received. -
As discussed, Transcript is best. IF you dare to provide the Federal tax return copy, it can't be just the 1040 which is only a few pages and not complete. They need the whole thing. All pages and schedules and including all proof of earnings... so W2s for employed and 1099s for self employed. As above, a 1099 is a earning statement for self employed. Are they? Offer letter, no. Current employment letter, yes. And that projected income amounts listed on it is your current income for the I864. Instructions state 6 months. Ensure you have read them. See above. Only if you are using assets because your income doesn't meet the FPGLs. Does your income meet it? Then don't use assets.

A transcript is a receipt from IRS that proves you filed taxes and reported your income accordingly. A tax return (1040) proves you filled out the tax forms but doesn't mean your income was confirmed nor that you even filed taxes as filling one out doesn't mean you filed. FILING taxes is a requirement to be a sponsor. The transcript is best.
