  3. Hi Everyone, has anyone ever filed Form I-131 in US after getting green card. I am moving to US to live with my husband but my son decided to stay in Canada. I don't want to lose his immigration in case he changes his mind in future. I found out about this form I-131 , which, as I understand, he can file from US upon entry and green card issuance and then leave back to live in Canada for two years. Then such form needs to be re-filed, etc, Question, while waiting for biometrics, which seems to take 6 weeks or so, can he go back to live in Canada and just come back for biometrics to US when time comes or he has to stay in US for 6 weeks? It is problematic with school in Canada, so I wanted to find out.... And in general, let me know if my understanding of how this works is wrong. Has anyone used the form or knows anything about it?   4. Hi Everyone, I am at the end of my process. just pending interview in Montreal consulate to get visa issued. Does anyone know , upon arrival to US and presenting all the documents, my understanding is that I am given right away temporary green card and the actual card comes few weeks/months later. Do you know if I can leave US to go to Canada right away for visits to parent my child who decided to live with his dad and not move with me ? It is important for me to not stuck in US for weeks or months upon arrival and have ability to travel back and forth right away. I was given two conflicting advises, one saying yes I can, the other saying I better wait for my actual green card that comes by mail ( I am not talking about spending more than 6 month in Canada, just visits).

  7. Hi all I ran into a tough situation. I am pursuing CR1 visa ( only interview left and scheduled soon) to move to live with my husband in USA. I have 13 years old son from prior marriage and I received court permission for my son to move with me but his dad started to put the child against the move. Currently the situation is quite unstable and I am not sure if child agrees to move to US with me. We have small baby with my husband so I have no choice but to move. I am worried if I run into situation that I am moving without my son but later he changes his mind and wants to move, it will be again almost 2 year process going through visa application etc. He is scheduled for an interview in Montreal in May and my understanding is that once visa is issued, we will only have 6 month to move or it will be expired. Note: - I understand that I can simply postpone his interview,I believe I can keep postponing it for a year since the date the 1st interview was scheduled ( correct me if I am wrong), but this is not an option for me due to specific circumstances that are long to explain here -The only option right now, if he really does not want to move as of this moment, for me will be to come to some legal agreement with his dad that child stays with him here but is free to move if he decides later. So, scenario I see is that I do get visas for both of us but I go and he stays here. IF he does not want to move within 6 months after visa issuance, are there any ways to keep his green card without living in US but living in Canada. We will have ability to go back and forth for him to visit USA but he would have to attend school in Canada, therefore most of his time he will be living in Canada, Which options he has to be able to keep green card or there is none? OR wouild you advise me to schedule a consultation with an immigration lawyer to clarify those nuances and possible options? Thanks very much in advance
  8. Hi all, has anyone gone through procedure of moving interview in Montreal consulate for later? Don't ask me why I need to know it ( long story and complicated to explain all here). In short, we got an interview date. We confirmed it, I later tried to check out the link in the email which is given in case people need to move or cancel appointment, it asks for case number etc to enter before further steps show up, but it is not available for me any further now since we confirmed interview already. I wonder what shows up when people actually try to move interview, does it show you the calendar of the consulate and the dates available so people can rebook online or is it something else? If it does show future dates, how far in future are usually the dates, is it a few months away from current date? thanks a bunch PS. urgent ask, please, share your experiences if you had those....

  10. Hi all, I have an interview scheduled in Montreal in 9 days from now but discovered original of my Canadian police clearance is missing. I will try to re-order but not sure I will get it on time. I did uploaded a copy though in the past during immigration process but I know they need original of all docs. Has anyone attended an interview with document missing and what happened after? Do they force to re-schedule and come again or allow to send the missing doc by post to consulate? Wonder if someone had gone through it and how much delay it causes as result? Thanks Tatyana
  11. Hi everyone, Has anyone gone through that scenario? We are at final stage of immigration , me and my son have an interview scheduled in Montreal in few weeks from now and I learned yesterday that my medical exam won't be completed on time, I need to take some further test which takes quite a while to get results back ( no express way) before medical can be approved by doctor. We have options to communicate with embassy and explain situation and ask for advise or try to just go ( we already booked train and hotels in Montreal which are non refundable) hoping they will treat this visit as my interview and tell me that once my medical exam comes to them, they will issue visa without asking me to come back ( and my son has medical ready, so I assume they can issue him visa after he completes his interview) I am hesitant if I should communicate with embassy about this whole thing now or just go, I am worried if I start communication, they will advise to re-schedule and I wonder if this route is longer...We have a lot on the plate to want to move ASAP. so I am trying to choose safest and faster way but dont know which one is best.. Maybe someone had any experience with going to interview without medical exam being completed or something similar? And I wonder what happened next to them?
  12. Hi, sorry if it is in wrong topic. We are currently pending spousal visa for me and my son to move to US to join my husband. However, now I am also expecting our mutual child with my husband, I live in Canada and our child will be born in Canada, can anyone refer me to what is the process to get the child legalized in US so all three of us can move smoothly once our visas are ready? I read about it a year ago but forgot what the name of visa is/or whatever this process is named. I remember it sounded relatively easy for newborn though whose father is American.
