  5. It would be DOS, not USCIS. Nigeria is in its own category in terms of fraud, and it sounds like they are investigating him. Typical fraud for that country is related to fake documents or falsified marital histories and familial relationships.
  6. May want to avoid using accountant as source of US immigration info. Your girlfriend will want to join VJ, and read and research the visa process thoroughly. There can be challenges that are unique to India.

  9. If what you mean by this is that one of your siblings has also filed a separate petition for you, then that's great, and that is likely the route you'll go. There is no stepping in as "substitute sponsor" for the existing petition, if that's what you meant though. I think your original petition is gone, and I do not see any humanitarian aspect to your situation as described.

  13. So that was obviously not USCIS' fault, right? Maybe USPS will offer some type of insurance reimbursement. You should definitely report it as lost to USCIS. I don't think there is any way around the I-90 processing fee or time, although you could request an expedite.

  16. @OldUseris correct. Request expedite, or abandon the AOS process and be petitioned. The possible bar refers to whether you accrued presence whilst out of status.

  18. No. There is no "changing" from a conditional to 10 year GC. You should begin reading about the process known as Removal of Conditions, which you will be able to start in around 2 years. Getting a GC and then immediately deciding to not use it as intended (to reside permanently in the US) definitely complicates things.
  19. Right. You have abandoned your AOS and ESTA is gone. Spouse needs to petition you for an IR/CR-1 visa. I understand that by adjusting from VWP, you may have been hoping to avoid the visa queue, but a trade-off of avoiding that is that you can’t come and go until you have a GC.

  21. Your only choice would be to refile. If the requested evidence wasn’t received by their deadline, an appeal will be futile, as it was not their error.
