  1. Is this newish? I went to Japan some years ago (2008ish), and it wasn't required then.
  2. An easier solution would be to eliminate the option to adjust status from NIV. Want to come to the US, meet someone and marry? Great, but you have to go home afterwards and be petitioned for an immigrant visa. How do they do it in Britain, @Boiler? Aren't there special visas required for foreigners to marry there?
  3. The fraud will be when you arrive on the J-1 (a nonimmigrant visa) with the intention of adjusting status and staying.
  4. No, you cannot. It is immigration fraud to seek admission to the US on a nonimmigrant visa with the intent to adjust status. She will need to petition you for an immigrant visa.
  5. No, this is immigration fraud. You should petition her for an immigrant visa asap. Some time apart is often unavoidable.
  6. I wouldn't count on anything being "approved" until the status is "new card is being produced."
  7. If you're suggesting that he can petition her if he isn't necessarily her biological father, then that would be a no. And with them being unmarried at the time of her birth, and him not being on the birth certificate, DNA would be the only option I can see. The burden of proof of relationship claimed in petitions for alien relatives is 100% on the petitioner.
  8. I would be very surprised if they don't request DNA evidence, especially with the birth certificate not listing him as the father. Sending money abroad is not evidence of a biological relationship.
  9. Really, that is your question? I'd be way more concerned about the communist party issue.
  10. I agree. A moving traffic violation would need to be, but not a parking ticket.
  11. Uh, as evidenced by the incorrect advice OP got from his accountant.....lol Provide just means to dispense. Doesn't mean it is factually correct.
  12. It would be DOS, not USCIS. Nigeria is in its own category in terms of fraud, and it sounds like they are investigating him. Typical fraud for that country is related to fake documents or falsified marital histories and familial relationships.
  13. May want to avoid using accountant as source of US immigration info. Your girlfriend will want to join VJ, and read and research the visa process thoroughly. There can be challenges that are unique to India.
  14. Have you checked the US Embassy for Haiti's website? I may be wrong, but I thought I remember seeing somewhere that Haitians are currently eligible to interview in Santo Domingo.
  15. Can you give a hint to those of us too lazy and unfamiliar with November's VB?
  16. If what you mean by this is that one of your siblings has also filed a separate petition for you, then that's great, and that is likely the route you'll go. There is no stepping in as "substitute sponsor" for the existing petition, if that's what you meant though. I think your original petition is gone, and I do not see any humanitarian aspect to your situation as described.
  17. Similarly, it doesn’t ask if you were handcuffed and taken to a cell. yes, it will be a big issue that your police record negates your answer on the petition. see the case of @John & Rose.
  18. I know your wife is excited to travel, but it seems unnecessarily risky in this situation- especially to stay out for several months???? I certainly would not do that until the GC was issued.
  19. Hopefully you have a plan for his health care? He will lose his provincial coverage, and will not be eligible to buy into Medicare for 5 years.
  20. So that was obviously not USCIS' fault, right? Maybe USPS will offer some type of insurance reimbursement. You should definitely report it as lost to USCIS. I don't think there is any way around the I-90 processing fee or time, although you could request an expedite.
  21. Yep, that petition is over and done with. Meet and marry, or meet and submit a petition. The meeting requirement is absolute.
