  1. It takes as long as it takes. It is one of the main reasons the K-1 is not a great option anymore, and has not been since around 2018. Looking at your post history, it appears you had some issues with providing properly completed forms and evidence. So the delay may be in part due to that.
  2. Just came here to try and figure out if it meant I was banned again 😅. Happening on my iPhone (Safari), but not Mac. Happened a month or so ago, but then spontaneously fixed itself.
  3. You need to look up info on using assets in lieu of income. Having a US bank account is completely irrelevant. Your wife will need establish domicile regardless. If you don't qualify on assets alone, you will need a joint sponsor, or she will need to return and get a job.
  4. @John & Rose has experience with this situation.
  5. Unfortunately, there is not going to be a way to avoid separation. And the domicile requirement for Montreal is very strict. You can always file the petition and then try to expedite at some point during the process. But plan on 18 months-2 years minimum. And in terms of bringing him over to “finish the process”- no, that is not allowed. Entering with the intent to adjust status is immigration fraud and could get him a permanent bar.
  6. Incorrect. There is NOTHING in the terms of a B visa that prohibits a visitor from marrying. They are prohibited from entering the US with intent to adjust status. Very different. As long as OP is truthful to CBP about the plan to return home and be properly petitioned for an immigrant visa, there is no problem with this plan.
  7. You cannot work remotely without an EAS. After filing for one (along with AOS), that can take months and months to arrive.
  8. Oh good! Didn’t want you to get scammed or end up with results they wouldn’t accept. Please keep us updated on how it goes.
  9. No. USCIS expects you to meet in a third country or your country to fulfill the requirement. Hopefully he has a plan for how he can afford to petition you and support you financially. You can try a third country. Btw, people in wheelchairs travel all the time.
  10. I know they’re unreliable. That’s why the AP takes that much longer.
  11. I recommend you seek professional help for this. Not everyone has the aptitude or literacy skills to successfully navigate US immigration.
  12. They won’t expedite background checks. And as to why the background checks were not done previously, surely you’re aware of the poor record-keeping and other issues of Pakistan? It’s the reason why NVC does not accept police records from that country.
  13. Ooh, I wanna request mine. It will say "SalishSea ran a red light in 2006 in Seattle, WA." Does it show inquiries from other agencies? Husband is in law enforcement, and I know they did background checks on me when he was going through the very thorough hiring process.
  14. She was denied for immigrant intent. If she is properly petitioned for an immigrant visa, that will not be an issue. However, you DO need to get your documents in order. Nigeria is notorious for fake documents. And contrary to what your lawyer recommended, the party line here on VJ is generally not to do a DNA test until the request comes from NVC or (more likely), the embassy. Embassies use particular DNA labs, and they will reject results from unauthorized sources.
  15. Clearly there is no visa number available for you, based on that Visa Bulletin. Do you have a specific question?
  16. Your case has one red flag after another. Is she out of status, or not? She will not quickly get a green card. If the "marriage" is for the purpose of getting the green card, USCIS will figure it out. Especially with an age difference like that. Sorry, but no 32 year old woman is legitimately with a 19 year old guy.
  17. If she’s not ready to live in the US, you should wait.
  18. Personally, if having them at your wedding is a priority, I’d choose a CR-1 and have the wedding in your country. otherwise, it’s a total gamble.
  19. Good question. Part of me thinks this could just be a matter of rattling the right cages. Do any of your local news stations have a consumer advocate/investigator? Maybe that seems far-fetched, but anything that can draw attention to his case is worth a try!
  20. Daisy, what has your senator/rep been able to do? Any chance to escalate it within that office (i.e. above the staffer who usually handles such requests)? Mr. Daisy is a USC, correct? Because this situation is nothing if not urgent for the health and well-being of a USC.
  21. At the border? Could this work?
  22. Does he plan to disclose the arrest on the I-129F? "Expunged" does not mean USCIS/DOS will not have access to records. You can of course include any supporting documentation you wish to, but USCIS will also run their own background checks, including FBI and state police.
