    They won’t expedite background checks. And as to why the background checks were not done previously, surely you’re aware of the poor record-keeping and other issues of Pakistan? It’s the reason why NVC does not accept police records from that country.

    Ooh, I wanna request mine. It will say "SalishSea ran a red light in 2006 in Seattle, WA." Does it show inquiries from other agencies? Husband is in law enforcement, and I know they did background checks on me when he was going through the very thorough hiring process.

    She was denied for immigrant intent. If she is properly petitioned for an immigrant visa, that will not be an issue. However, you DO need to get your documents in order. Nigeria is notorious for fake documents. And contrary to what your lawyer recommended, the party line here on VJ is generally not to do a DNA test until the request comes from NVC or (more likely), the embassy. Embassies use particular DNA labs, and they will reject results from unauthorized sources.

    Your case has one red flag after another. Is she out of status, or not? She will not quickly get a green card. If the "marriage" is for the purpose of getting the green card, USCIS will figure it out. Especially with an age difference like that. Sorry, but no 32 year old woman is legitimately with a 19 year old guy.

    Personally, if having them at your wedding is a priority, I’d choose a CR-1 and have the wedding in your country. otherwise, it’s a total gamble.

    Good question. Part of me thinks this could just be a matter of rattling the right cages. Do any of your local news stations have a consumer advocate/investigator? Maybe that seems far-fetched, but anything that can draw attention to his case is worth a try!

    Daisy, what has your senator/rep been able to do? Any chance to escalate it within that office (i.e. above the staffer who usually handles such requests)? Mr. Daisy is a USC, correct? Because this situation is nothing if not urgent for the health and well-being of a USC.

    Does he plan to disclose the arrest on the I-129F? "Expunged" does not mean USCIS/DOS will not have access to records. You can of course include any supporting documentation you wish to, but USCIS will also run their own background checks, including FBI and state police.

    Yes, much later. The petition will take up to 15 months to process, possibly more with a felony background. The USC needs to be the one to submit the petition. Also, hopefully you realize that you can visit on the VWP (subject to CBP), but you can’t just come and live in the U.S. during the process.

    Immigrating without some temporary separation is very unlikely. One thing you should really listen to in this thread: Montreal is notoriously strict when it comes to domicile. His being up to date on filing federal income taxes is great, but it won't be enough.
