  1. How did he enter the US? Who petitioned him?
  2. Is she your spouse or fiancée ? You refer to both, which can lead to problems for you.
  3. Depending on the reason, marrying may not lead to a visa either. May want to consider the USC moving to your country if you still want to be together.
  4. Any sort of deception at a consular interview is not recommended, and can come back to bite you later. Obviously he was planning to visit you had he gotten the visa. There is no way to know at this point if it will be an issue for an immigrant visa, but going forward, just be truthful.
  5. OP are you already married?
  6. Why did you leave all your documentation in the UK? And sorry, but nothing adds up about your story. Particularly the idea that you are in the US on a visa afforded only to high-achieving geniuses.
  7. If all it takes for you to guarantee your MIL gets a tourist visa is to “pull strings” via a phone call, why would you even consider making a 15 hour $2k flight?
  8. You can absolutely ask for your passport back and return to the UK.
  9. That doesn’t make sense. CBP “confiscated” your passport? Where are you now? Were you admitted? EB1A visas are for Nobel/pulitzer prize winners and the like. I hardly think you’d be fired from such an esteemed profession for something like that.
  10. No, it won’t. All immigrant visa interviews for Canada are done in Montreal.
  11. That’s not how that works. Doctors don’t make the vaccine requirements. You definitely need a waiver, which is only approved by the consulate, and adds 1+ year to the overall wait time for a visa.
  12. And as the father is now in his 70s, it would be extra “insurance” to at least have a sibling petition filed.
  13. The ONLY course of action are the choices they gave you. Witnessed compliance with TB regimens is very common. The US has worked very hard to eradicate TB, and unfortunately other countries have not. It doesn’t matter that you “expedited.” She has a medical inadmissibility. If she wants a visa, she has to comply with the conditions to get it.
  14. Will take many many years. If you are a USC, you may want to also petition for sibling in case the father doesn’t live that long.
  15. He will not be denied entry at POE if he has a valid visa. The medical inadmissibility is evaluated exclusively by the consular officer.
  16. “and I asked what evedince her mother brought and she said nothing just her passport and she was approved.” Right. Because B visas are evaluated entirely on the info contained in the DS-160 (the visa application). They are not obligated to look at any extraneous info brought to the interview, nor do they.
  17. Do you really think that being “tall and gregarious” would influence whether her visa is approved or denied?
  18. Have you ever met in person before?
  19. They think you’re going to try to work/ overstay. The onus is on you to demonstrate this isn’t the case on future applications. Future visa chances depend on exactly what I’ve just said, as well as the terms of the visa you’re trying to get.
  20. They wanted to check your passport for recent travel…..
  21. Whatever they have declined to release regarding your case is specific to your case. Like I said, there is nothing you can do about it.
  22. LOL, you don’t have to call us “Sir.” Visa Journey is a public website, not affiliated in any way with the US immigration systems. The letter is stating that they declined to provide certain pages of the file because (for whatever reason) the risk of harm from releasing them outweighs your right to have them. The law requires them to evaluate this risk (it’s “standard”) for all FOIA requests. There’s nothing you can do- it is what it is.
