  1. You need to have a license to practice as a nurse. The NCLEX is the national exam for licensure. I don't see how an employer could petition someone for a work visa who is not yet qualified for the job.
  2. You do not have to wait until you are divorced to remove him from an employer-based insurance plan. I'd do it asap.
  3. Not sure what would be reportable here - they obviously consented to having the cousin prepare the documents, etc. Maybe not a wise choice in retrospect, but not illegal.
  4. And yet you submitted documentation for the bonafides of the marriage? Was this an arranged marriage/are you related? Unfortunately, some people just suck, but USCIS cannot force someone to stay in a marriage they don't want. The biggest lesson here is to spend as much time as possible in each other's presence before committing to marriage/sponsoring an immigrant. Time spent together is the only way to get to know someone's character. I agree with the others, get a divorce lawyer and move on. Even if your spouse's whereabouts are unknown, you can divorce. Sorry this happened to you.
  5. That is very unusual, normally for K-1s they leave the relationship vetting to the consulates. Are there big red flags in your situation?
  6. It is possible, although I don't think petition approval times are taking quite that long currently. As you have seen, it fluctuates, and USCIS would rather give themselves extra time to minimize the number of inquiries flowing in.
  7. The reason you have to wait until after a certain date to submit an inquiry on your case is because there is an official processing window. Processing times and predictions fluctuate all the time.
  8. I don't see any issues here at all. Singapore is a low fraud country. Our situation was similar: we are in our 50s, I already owned my house and we never refinanced/ added husband to the deed etc. No issues or RFEs for AOS or ROC. We have never submitted snapshots with any of our petitions. Do you have any shared insurance policies, or have you named each other as beneficiaries for retirement/investment accounts?

  15. Some of the advice given in this thread is bordering on advocating lying to CBP. If asked directly, she absolutely needs to tell the truth about her intentions. Failing to do so is a great way to get a swift removal and a ban.

  18. There are widespread issues in the US right now with getting in to see even primary care physicians. Many are not accepting new patients. A lot of health care clinicians have left health care altogether.

  20. Right. My point is that if she applied as married (but was not, as is common in some African countries), that could be the source of her issue.
  21. It’s not you “bringing” someone here on a tourist visa, she applies on her own. There is no sponsorship. She needs to be completely honest about her intentions.
  22. It’s not optional. The one you obtained 18 years ago to immigrate to Canada is not relevant for US immigration. If you can’t get it in time for the interview, you should attend the interview anyway. You will get a 221g pending the consulate’s receipt of the PCC. Your case will be in administrative processing. Expect extra time if you’re from a high fraud/high risk/MENA country.
  23. Is she from an African country, and did she previously apply for a visitor visa claiming to be married when she was not?
