  1. No one here is going to recommend that you continue to do that. Green cards are for living in the US. If you don't wish to live in the US, why do that? And - if you are sponsoring your husband, how are you going to meet the US based income requirements?
  2. Visa Journey. Please read the guides! Don't assume, that's how mistakes are made, and delays caused. Please own your process and do the research.
  3. Most are denied for presumed immigrant intent/lack of ties to home. So if that was the reason for the denials, she should be fine for an immigrant visa. However, like Crazy Cat said, if she (or the ‘agency’ she hired) made a false claim on a B-2 application, that could complicate things significantly.
  4. That info would have been crucial for this ENTIRE thread. Why would it matter? He does not need a visa! Why is this even a thread??
  5. Obviously the police report is required, and you will not get a visa without it.
  6. So you’re an LPR trying to petition a spouse with an AWA crime? Sorry, I don’t see that happening, ever. And no appeal will change the documentation that you’re required to provide.
  7. How would they be eligible for a fiancée visa once married??
  8. When was the petition filed? Sibling visas take 25 years or so.
  9. Please do some reading. This is a DIY site. You need to own your process and read the guides. If you still do not understand, look into hiring help, as suggested.
  10. I don’t see an expedite being approved, as obviously the treatment is available here in the U.S. I agree with the Cat, have the biopsies done asap. I’m confused about what you wrote about doing the biopsies vs surgery. In general, that would be a discussion to have with the surgeon or oncologist- not something you decide on your own, based on cost. There are rationales (medically and surgically) for biopsying tissue prior to resecting an entire organ or body part.
  11. They are already dual citizens and eligible for British passports. My kids are dual British/US citizens (born in the US) because their dad was born in the UK.
  12. I have never heard of a conditional green card being extended without an ROC in process. Is this new?
  13. Yes, the huge age difference is the reason they do not believe it is a bonafide marriage. Perhaps your spouse can move to Nigeria to live with you there.
  14. Yes, they've shut down ALL international USCIS offices. Hence the need to get permission ("exceptional circumstances), and a written job offer is a common qualifying reason. You could look into the Utah online marriage as an option, since you're currently together. I don't have enough Philippines-specific knowledge to comment on the practicality of this, but someone who does should be along shortly.
  15. Most around here would strongly recommend the CR-1 over the K-1, for many reasons. @Crazy Cat has a great comparison list. I don't think your age difference will be an issue at all, and since same-sex marriage is (still) legal in all 50 states, there is absolutely no issue there either. So will you return to the US after starting your job? As in next month? By the time your partner gets an interview, you will have been working for awhile, with ample payslips to show current income. DCF (direct consular processing) may also be an option since you have a job offer. You would need to get married asap, and then get permission from the consulate to do that process. I don't recall seeing many doing DCF through Manila, perhaps @pushbrk has insights.
  16. It is extremely unusual for a USC petitioner to be called for biometrics. Any red flags in your past?
  17. What do you mean “the I-130 is for the baby”?
  18. Adopting to circumvent immigration laws screams of fraud to me….
  19. It's based on the totality of circumstances. If you're marginal, trying to time a petition submission around the federal poverty guidelines does not make sense. You're better off seeking a well qualified joint sponsor, or trying to improve your income.
  20. How is he able to take 6 months off? The consulate will wonder about this. You may want to temper your hopes, as he could well be rejected for a B visa.
  21. The fees changed on April 1st. If you don't send the correct fee, it will be rejected and returned.
