  1. Seems like you do not understand the purpose of DCF……. It is for the spouse of a USC living together in the country where the consulate is located. You can’t consulate shop. Just file the petition online.
  2. Although, with a recent history of seeking a K-1, you were obviously prepared to do all of this. See the conundrum here?
  3. Had you previously applied for a tourist visa back in your country prior to the F1?
  4. Agreed. There could also be questions related to marital status listed on previous nonimmigrant visa applications.
  5. I doubt it. Every state is different, but in general, married people are considered to be responsible for each other's debts/liabilities.
  6. Priority date. When a visa number becomes available for this person, NVC will forward the petition to consulate. Very very long wait times for Philippines.
  7. Certain types of crimes in the petitioner’s background trigger the transfer from CSC to Vermont. It can take several years to complete the background checks and adjudicate whether the the petitioner is eligible.
  8. Honestly, I’ve thought your case has sounded “off” since you started posting here. I’d say he’s showing you who he really is. Sounds like he may even be undertaking a common scam for his country, where he comes over, divorces, and then petitions for his “real” wife back home. You can report suspected fraud on the USCIS/DOS websites. You can notify the consulate in writing if you want to withdraw as petitioner/sponsor. best luck, and hugs.
  9. Is that affidavit signed at the consulate just in cases where the USC is seeking to marry in that country?
  10. Again, your understanding is incorrect. Your husband is applying for a VISA, not a green card. He will not use that form at all. You may be one of the few who would benefit from the help of a lawyer for this otherwise straightforward case. Going into this without an understanding of the process can really cause pitfalls.
  11. NO. He CANNOT come back as a tourist and adjust status! That’s fraud! You need to carefully read through this thread and website. He will be applying for an immigrant visa at an overseas consulate. It will take around two years. During that time, he can visit if allowed in by CBP. He CANNOT adjust status/move here through the B2.
  12. “You’re not sure you can afford getting rejected?” Why? What is the urgency, if it’s just for a vacation? There are no guarantees. As far as how to answer, you have to be 100% honest.
  13. Right. I just wanted to clarify for everyone else that no special connections are needed. As far as ‘digging’ for info, that would also not be an issue. US senators and congressional reps websites have all the info needed for constituents to request their assistance with federal agencies.
  14. Nope. Your current marriage is not valid for US immigration. You would need to divorce current wife, finalize past divorce, and remarry.
  15. No "connections" required. Any USC/LPR can ask their US senator or congressional rep with help with any federal agency (they are required to help - it is codified into law). They don't "pull strings," and it is not "putting heat." They simply inquire on the progress of their constituent's case.
  16. Governors are not federal, and as such, do not help with federal agencies such as DOS.
  17. I haven't heard of anyone requesting (or being approved for) an expedite for AOS, as the AP/EAD is sure to be approved long before. Did you not apply for AP/EAD?
  18. No provider is going to conduct a telehealth visit with someone who is located outside of where they are licensed to practice. Or for that matter, with someone who is not insured/pre paid.
  19. Correct, your valid visa can be used for the reasons stated, even though it was originally applied for for a different purpose.
  20. NVC will not expedite a numerically limited visa (for which there is no visa number available yet), for any reason, including medical. If she is already receiving treatment, why would she need to come to the US for treatment? The only option would be a B visa for medical, but with your ties to the US, getting that is unlikely. And how do you plan to pay for it? You will need the cash up front, since you won’t have insurance. Medical care and drugs in the United States are extremely expensive. Infusions of immunotherapy drugs for autoimmune disorders like Lupus can cost $20k per dose! Sorry, I think you’ll have to wait for your immigrant visa PD to become current.
  21. There is no way around the inevitable separation with either path. She cannot come here and stay without an immigrant visa, that is fraud. Either route taken will take about 2 years. US immigration is not cheap, or fast. I suggest you spend some significant time reading and educating yourself on the processes, to about pitfalls and delays. Good luck!
