  2. I-129F petitions are taking 15.5 months for approval/RFE now. No one can predict if yours will take extra time. Definitely disclose the prior petition and the criminal history, and provide all supporting evidence as required. Does not matter that it was non violent/expunged - you must still disclose it and submit all police/court documents.
  3. Then that is entirely within your control, since you would have to fill out and sign a separate form for that. Sounds like they will need to seek a joint sponsor when the time comes, or an entirely different qualified petitioner. You may also want to bring to her attention that they will not be eligible for medicare or social security for many years (if at all, depending on whether they intend to work), and that bringing elderly parents over without a solid plan for funding their health care can lead to financial ruin.
  4. Unemployment is not a means-tested benefit. It is insurance that you and your employer pay into with each paycheck. Not sure what you are referring to in terms of retroactive laws, but I can't see any government agency seeking repayment for such. For example, even as tax laws are changed, it doesn't change the status of taxes paid/filed under previous law.
  5. As the petitioner and sponsor, she will submit the I-864. She will sign that form and provide supporting documentation of her income. If you wanted to combine your income with hers, as a household member, you would submit the I-864A. Do you file federal taxes jointly? Immigration is expensive, and a reasonable expectation would be for her to get a job if she wants to sponsor immigrants.

  7. Nope. And now that she’s a USC, you’re off the hook for her I-864. Are you divorcing? You’ll need a good lawyer, but not related to immigration, as that chapter is done.
  8. Seems like you do not understand the purpose of DCF……. It is for the spouse of a USC living together in the country where the consulate is located. You can’t consulate shop. Just file the petition online.

  11. Agreed. There could also be questions related to marital status listed on previous nonimmigrant visa applications.
  12. I doubt it. Every state is different, but in general, married people are considered to be responsible for each other's debts/liabilities.
  13. Priority date. When a visa number becomes available for this person, NVC will forward the petition to consulate. Very very long wait times for Philippines.
  14. Certain types of crimes in the petitioner’s background trigger the transfer from CSC to Vermont. It can take several years to complete the background checks and adjudicate whether the the petitioner is eligible.
  15. Honestly, I’ve thought your case has sounded “off” since you started posting here. I’d say he’s showing you who he really is. Sounds like he may even be undertaking a common scam for his country, where he comes over, divorces, and then petitions for his “real” wife back home. You can report suspected fraud on the USCIS/DOS websites. You can notify the consulate in writing if you want to withdraw as petitioner/sponsor. best luck, and hugs.

  17. Again, your understanding is incorrect. Your husband is applying for a VISA, not a green card. He will not use that form at all. You may be one of the few who would benefit from the help of a lawyer for this otherwise straightforward case. Going into this without an understanding of the process can really cause pitfalls.
  18. NO. He CANNOT come back as a tourist and adjust status! That’s fraud! You need to carefully read through this thread and website. He will be applying for an immigrant visa at an overseas consulate. It will take around two years. During that time, he can visit if allowed in by CBP. He CANNOT adjust status/move here through the B2.
  19. “You’re not sure you can afford getting rejected?” Why? What is the urgency, if it’s just for a vacation? There are no guarantees. As far as how to answer, you have to be 100% honest.
  20. Right. I just wanted to clarify for everyone else that no special connections are needed. As far as ‘digging’ for info, that would also not be an issue. US senators and congressional reps websites have all the info needed for constituents to request their assistance with federal agencies.
