  1. AOS is rarely expedited. In 7 years of reading VJ, I’ve not seen that happen. Most expedites would be for the AP/EAD. So how do you currently have US health insurance? Sorry to hear about your cancer diagnosis. Even without that, you would have needed health insurance. What was your plan for that when you decided to adjust status?
  2. I added my husband to my employer-based health insurance long before he had his green card. Why would having a green card be a requirement? I have never encountered any type of health insurance enrollment form that asks for immigration status.
  3. Well, in that case, yes. I am not aware of any countries that allow non-citizens to vote. Would be interested to know which ones do.

  8. Oops, now I see that you wrote 2021, not 2022! In that case, yes, you may well be much further along in the process by then. It’s possible she may even have her visa by April. I would suggest you look at recent London timelines to get a more accurate view of how long the NVC to consulate/interview part of the process is taking, as it could be tricky to plan for a long trip over.

  10. Unfortunately, you will not be eligible for a Green Card because the petition upon which it was based is void.
  11. You should have received a receipt notice ('NOA1) within the first month after sending the petition. Currently, petitions are taking 15.5 months to adjudicate. Nothing in US immigration is how it was years ago.
  12. Yes, that is the length of time it takes to adjudicate/approve your petition. Once approved, it will be sent from the California Service Center (CSC) to the NVC (National Visa Center), where it will wait until requested by the London consulate. That part of the process generally takes another couple of months, depending on how backed up London is. They will notify you (or the beneficiary) of next steps in terms of scheduling medical, obtaining police reports and scheduling interview. That part is consulate-specific and subject to change, but in general that is the course of events. There is not a lot you can be doing at this point, besides getting your available IRS transcripts (i.e for 2020, 2021, and eventually for 2022). As you can see, there is a lot of waiting during the immigration process. Best luck.
  13. It is all about intent at the time of entry to the US. You already know what your intent is. Don’t commit fraud. Do things the right way. Waiting is just part of the US immigration process, we all go through it.
  14. Depending on how long you want to delay the reissuing of the visa, it’s quite possible. Consulate has full discretion since you’re requesting something unusual.
  15. All US senators are required to assist constituents with federal agencies. In terms of immigration, the assistance their staff can provide is by making an inquiry as to what is happening with your case (in very general terms- they won’t be given specifics). They can’t impact a decision or expedite.
  16. I don’t think you understand the K-1 process very well at all. Best to do a bit of research and try to become educated about it if you want the visa.
  17. They will suspect that you are already married, and deny your visa because you won’t be eligible for the K-1.

And in terms of the laws pertaining to intent, what do you think would happen if your gf was completely honest at POE and told CBP that she intends to marry and AOS to stay whilst on a non immigrant visa or ESTA? Would she be admitted?
  19. Think about it….applying for a non-immigrant visa when you have immigrant intent….. unlikely to be approved. There are no loopholes or tricks to employ to avoid the wait times, or for the intending immigrant to live in the US while waiting. If those things existed, don’t you think we’d all do them?
  20. You left out that huge detail in your story, lol. Do some research. This is extra security and betting because of his background, and likely will take many months or more.
  21. You cannot come here to marry or stay (on either ESTA or B2). If you marry, she will need to properly petition you for a spouse visa.
  22. USCIS doesn’t “indicate” anything along the way. They won’t hold your hand, and they expect you to keep informed on your own processes. Do a bit of reading and research and become educated about how it all works. The fact that you called the NVC about your I-751 shows a lack of knowledge.
