  1. @Allaboutwaiting, this is what I was trying to explain to you about the policy for B validity/duration of stay and reciprocity.
  2. Viet Nam is notoriously tough on K-1s, due to widespread fraud. Is there a reason why you do not marry and pursue a spousal visa instead?
  3. How would you trade an interview date? Interviews are scheduled for specific people.
  4. If you read through the entire thread, what he said was inconsistent.
  5. You changed your initial reason for coming over on a student visa - the MA program at a well known university vs a private run-of-the-mill English language school.
  6. That is totally different from what you said in your original post though.
  7. Not if he is out of the US. Learning the terms associated with the immigration process is something you should consider. Knowledge is power. You have a long and complicated journey ahead if you want to bring him to the US.
  8. Is your son a US citizen or green card holder?
  9. I would assume so too, but bringing over people from your country that you marry without knowing well should be a caution for everyone.
  10. Oh, I see. Then it is really more like defaulting on a debt owed, which I doubt ICE is going to care about. If it was marriage fraud, it will be very hard to prove. However, if he divorces and then attempts to petition a new wife, I’d expect scrutiny. Chalk it up to another reason to perhaps date locally, since with overseas relationships it is much harder to really get to know a person’s character.
  11. OP, I am not familiar with Indian law or dowries. Are you saying that he has committed bigamy by remaining married to the first wife while marrying your USC sister?
  12. The return ticket and evidence of ties to home (does she have a job? Employer letters detailing expected return date for work can help) are your best bets.
  13. No, there are reciprocal considerations by country for the visa length as well Anyway, to reiterate what I said: not all tourists will get the 6 month stay approved at CBP.
  14. In general, B visas are issued for a 10 year period, and length of stay per CBP is up to six months. However, people with B visas issued in certain countries can get significantly shorter periods of both visa validity and length of stay.
  15. Here is the FAM: https://fam.state.gov/fam/09FAM/09FAM040309.html https://fam.state.gov/fam/09fam/09fam040202.html
  16. Multiple posts on VJ. Have a look, you can search if you want.
  17. K-1s do not submit documents to NVC. CR-1 process is totally different.
