  1. Uh, she CANNOT. You really need to do some research. You also may benefit from professional assistance with the visa process, because you do not understand how it works.
  2. $8k USD for a flight? Maybe if you insist on first class, but otherwise very much doubt that.
  3. It doesn't have anything to do with which visa a person originally came to the US on.
  4. I do not recommend post-dating any payments to USCIS. We have seen people get burned by that, and USCIS will reject the entire package. Send the payment when you have the money in your bank.
  5. You can, but with no credit history, it will be a challenge.
  6. You cannot work without the EAD or green card. Have a look at your state's DMV website to see if you can drive - all states are different.
  7. I would make sure that everything is as up to date as possible. When my fiance's interview was scheduled, I put everything into a PDF and sent it so he could print it out. You may be overthinking this.
  8. You will need to make an appointment with an approved civil surgeon for your medical exam. Have you done that?
  9. Why are you gathering supporting evidence for the I-134 if the interview is not until 6+ months from now? Ideally, it would be as current as possible. It is brought to the interview by the beneficiary.
  10. They will not be able to live or work in the United States for at least 20 years. So, no.
  11. They cannot stay beyond the time given by CBP when they arrived. The sibling visa will take at least 20 years for India.
  12. Nothing has been adjusted yet. You likely have at least another year before you get a GC interview.
  13. Nothing can be filed until you are legally married and have the marriage certificate. Anything you send before that will be rejected outright. Showing commingling of finances, etc, will be done in about two years, when she is interviewed for the GC. You do not need a joint mortgage.
  14. Dude, please read the guides ASAP. You need to have an official (certified) copy of a marriage certificate in hand before anything is filed. It may be a "hassle", but like it said, it is the deal you're signing on for by having her adjust status in the US (and thereby avoiding the long queue), rather than do consular processing.
  15. Expect not to have the visa until two years from filing the petition.
  16. Ah, I was going by their profile, which lists IR-2, a visa that does not allow for derivatives.
  17. She should realize that doing it this way avoids the consular queue, but the consequence is not being able to travel or work for up to a year. Green card is taking even longer. You can’t file anything until you have the certified marriage certificate.
  18. If they needed to travel home, maybe adjusting status vs petitioning them properly wasn’t the smartest move.
  19. Very much doubt that she will be able to interview in a country where she is residing illegally. Also- why risk her ability to ever travel to Mexico again by having her overstay?
  20. That is a high fraud consulate, so you will want to have spent as much time together in person as possible, especially since your family is not aware/supportive of your marriage. You don't need shared bank accounts, but why, as an adult, does he not have a bank account? Also, the consulate may deny that joint sponsor. Financial qualification is not the only consideration.
  21. We did both forms, and never had an employer letter. Payslips are better evidence of employment.
  22. We are 12/2021 filers, biometrics reused and case is at LIN. No 48 month extension letter received yet.
