    I do not recommend post-dating any payments to USCIS. We have seen people get burned by that, and USCIS will reject the entire package. Send the payment when you have the money in your bank.

    You cannot work without the EAD or green card. Have a look at your state's DMV website to see if you can drive - all states are different.

    I would make sure that everything is as up to date as possible. When my fiance's interview was scheduled, I put everything into a PDF and sent it so he could print it out. You may be overthinking this.

    Why are you gathering supporting evidence for the I-134 if the interview is not until 6+ months from now? Ideally, it would be as current as possible. It is brought to the interview by the beneficiary.

    They cannot stay beyond the time given by CBP when they arrived. The sibling visa will take at least 20 years for India.

    Nothing can be filed until you are legally married and have the marriage certificate. Anything you send before that will be rejected outright. Showing commingling of finances, etc, will be done in about two years, when she is interviewed for the GC. You do not need a joint mortgage.

    Dude, please read the guides ASAP. You need to have an official (certified) copy of a marriage certificate in hand before anything is filed. It may be a "hassle", but like it said, it is the deal you're signing on for by having her adjust status in the US (and thereby avoiding the long queue), rather than do consular processing.

    Expect not to have the visa until two years from filing the petition.

    Ah, I was going by their profile, which lists IR-2, a visa that does not allow for derivatives.

    She should realize that doing it this way avoids the consular queue, but the consequence is not being able to travel or work for up to a year. Green card is taking even longer. You can’t file anything until you have the certified marriage certificate.

    If they needed to travel home, maybe adjusting status vs petitioning them properly wasn’t the smartest move.
