  1. Very, very common at the moment for Montreal. I suggest joining the very active thread linked by Allaboutwaiting, it is full of people in extended AP with no known red flags or reasons. Many have had to undertake lawsuits to get things moving after a year or more in AP. Hopefully yours is not that long.
  2. Was there a reason why you just let the petition sit at the consulate? You can request your passport back at any time, and you could have all during AP. Now the USC can either file for a new petition, or you can marry and file for a CR-1.
  3. Sounds like a question for a local lawyer in the Philippines.
  4. Under normal circumstances, spousal visas take up to two years. Yours will very likely take much longer, so you won't be living in the US for several years. He will need someone eligible and willing to be a joint sponsor. You don't need to live the joint sponsor.

  8. Philippine laws are irrelevant in the US. Any adoption approved by the court where you live will be based on state laws.
  9. Then why did you start this thread saying you had no idea why the ESTA was denied? Obviously the overstay is the reason. The date CBP requires a visitor to leave is not just a suggestion.

  11. Nope. She'd have to have lived in your custody. 2 x/year visits do not count. Also, if her bio parent is alive, her adoption will not be honored by USCIS AFAIK.

  13. No state government has the right or ability to confirm whether any marriage has been sexually consummated. Therefore, that cannot be a parameter for a legal marriage.
  14. I'd expect scrutiny. Mom and teen daughter come to the US on a B visa, and mom just happens to meet someone to marry, and now wants them both to adjust?

    She is not eligible for ESTA. She can apply for a B visa.
  16. Have you read the USCIS instructions? They clearly specify no binders. Any additional fluff that makes it harder for them to disassemble the packet is probably not a smart choice. The optional checklist/instructions that go with the form is a great resource, and a much better source for info then YouTube, etc.
  17. I’m certainly not berating anyone. I’ve been on VJ for 7 years, and we did a K-1. So my advice is based on that. YMMV. Like Mike, I’m out.
  18. This is getting silly. To clarify for others: The requirement to have met in the immediate two years is absolute. Receipts from restaurants hotels, , events, etc around the time of the meeting are good, as is evidence that you actually took the flight (not itinerary or receipt- those do not confirm that you travelled). This is all primary evidence. Photos taken together is considered secondary, as the date it was taken is not always verifiable.

  20. Ask for stamps, if you want them. Or an electronic document showing admission (similar to our I-94). Believe it or not, there is a record of your admissions/departures from other countries.
  21. What I mean is: using an emailed itinerary in lieu of passport stamps or boarding passes will not work. People book flights and do not travel all the time. Can you get a printed boarding pass and check your luggage and then fail to board the plane? Yes. But, realistically does that happen? Historically, boarding pass and passport stamp have been widely accepted as evidence. Passport stamps may be requested at any border.
  22. Itinerary will not be adequate. It doesn’t ‘prove’ that anyone travelled or met. Boarding passes and passport stamps are a critical piece to this.
