  1. No. Unnecessary. She needs to complete the I-864. Income earned abroad that will not continue once in the US is not considered. have you looked at the domicile requirements? Most Americans living abroad will need to return to the US before their immigrant spouse to sort out a job, etc. Even if she wasn’t required to pay income tax, Americans living abroad are supposed to file a tax return. Your spouse is your sponsor, and as such, she needs to compete the affidavit of support and all supporting documentation. Any eligible joint sponsor will do the same.

  10. The petitioner can withdraw the petition by contacting the consulate. I would do it via email, and put your names and something like "URGENT/PETITION WITHDRAWAL" in the subject line, so that it doesn't get missed. May I ask why you want to do this?
  11. The lack of time spent together could be an issue. However, ten years is long time. How much time have you spent in person together? Has most of that ten years been online only? Whatever the issue was for the K-1 could well come back for the CR-1. Usually people have some idea of the reason for a revocation or denial. What red flags do you have? Pakistani males are often very heavily scrutinized. Is there a large age difference? Religion difference? Previous marriages? Are you related by blood? Your physical location at the time of filing the petition is irrelevant, since I'm assuming you'll file online.
  12. I wish you well, but please discuss with your fiance his plan to provide for your health care needs in the US. It is very expensive, and the best case scenario is that he has a job with excellent health insurance that you can be added to. Unfortunately, I don't see an expedite happening, because there is nothing urgent about the situation, nor would it benefit the USC. Never hurts to try though.

  14. USCIS does not contact courts at all. The burden is on the petitioner to provide all related documentation.

  17. No, they will not handcuff your children. Do you live in an area near a border? VJ tends to recommend that if people cannot file for some reason, that they should “lay low” to avoid being detained by the border checkpoints.

  19. You’re right, they would be out of status and subject to deportation. Not wise to wait to file.
  20. Sounds like it was simply a timing issue. ROC was approved prior to oath, but card was produced late.
