  1. We have never provided any photos for any part of the K-1/AOS/ROC/N-400 process (although N-400 is under 5 year rule). At our ROC interview, the officer wanted to see our elopement wedding selfies, lol. Snapshots are definitely secondary evidence when it comes to showing a commingled marital life. Was that 3 year or 5 year rule?
  2. Most here who did K-1s (with hugely variable timelines) would do a CR-1 if having to do it over again, particularly with the uncertainty surrounding US immigration presently. During Covid for example, consulates prioritized spousal visas vs K-1s. And not being able to work or travel for up to a year may not sound like much, but the effect on the immigrant can be significant.

  10. And the “issues” are in part based on behavior of others from his country- there is an algorithm. People from Western European countries are able to get tourist more easily because their rates of overstay are lower. Also- if anyone else in the family came here on a B and overstayed/adjusted, that will reduce his chances.

  13. This is a green card marriage, you are 100% being used. Once she has her green card, she will petition her actual husband. Odd that you’re already asking about petitioning others, but hopefully at 54 you’ll carefully consider getting to know someone properly first.

  16. Also she should keep in mind that it can take months and months to get a travel document, so if she needs to leave in an emergency, she would have to abandon the adjustment process. Yes, absolutely you must have evidence of this.
  17. You are the USC petitioner, correct? I am not a lawyer, but my observation is that the petitioner’s criminal background MUST be disclosed, and that unless the crimes involve AWA type offenses, it generally is not a barrier to petitioning someone. USCIS is more concerned with the type of behaviors/crimes that could hurt a beneficiary or their minor child. Be honest in all your dealings with USCIS, and consult a lawyer if you feel you need to. You will want to get copies of your criminal records and all court records. You can also order an FBI background check on yourself. Transparency and disclosing everything up front is the way to go.
  18. I think you misunderstand this process. It is discretionary to the consulate, and based on the totality of circumstances, not just on numbers on paper. Apparently they think your beneficiary is likely to become a public charge. Your options are: joint sponsor or qualifying income.
  19. There was some evidence this one weird trick worked, but that was several years ago. It no longer seems to have that effect. OP, the K3 is likely to be paired with your I-130 and administratively closed.
  20. Yes, for the I-134 I wouldn't expect any issues. However, keep in mind that you will soon be submitting the I-864 for AOS, and the new administration may well implement additional public charge requirements, like they did previously.
