    That’s unfortunate. Cut your losses and move on….there’s nothing that can be done now. For others reading, this is a lesson in why it is SO important to spend as much time as possible together before marrying. Two visits in 5 years of marriage is not enough time to know someone!

    You will have the extension letter (probably by then it will be for 60 months, lol) by then. You absolutely wouldn’t want to travel without it on an expired GC, primarily because you could be denied boarding by the airline.

    You will be presumed to have abandoned your AOS process if you leave without parole. If your spouse petitions you for a CR-1 while you’re home, you could potentially visit on ESTA, subject to CBP- but being that you had clear, recent immigrant intent, that may not be feasible. You certainly cannot live in the US whilst the CR-1 is pending.

    Unlikely she would have an immigrant visa by the time he’s graduating, but definitely start the process asap, as it can take up to two years.

    Yup, although they rarely come back to tell us what transpires after USCIS requests evidence that the previous fake marriage was legally terminated.

    She cannot “re-use” the K-1. You can petition her again, or just marry and petition for CR-1.

    Oh yes, but that’s different. The Nigerians who list a fake marital status on the DS -160 in order to increase chance for tourist visa end up paying the price when they want an immigrant visa later, and that marital status must be addressed.
