  1. Is a waiver needed though? Isn't overstay/illegal work by immediate relatives of USC said to be overlooked by USCIS?
  2. Very odd reason to delay the visa by over a year. There must be more to this.
  3. My thoughts exactly. I can think of one particular member who is encouraging anyone 25 minutes into a normal wait time to file.
  4. So he's been here illegally for >20 years. If I were you, I'd stop fretting about the EAD, certainly don't try to expedite it, and just be happy your parents were not deported and given a very long ban.
  5. All denials have a solid reason, and it is not a luck based system. Pakistan, like other countries with high levels of extremism and fraud, is a rough consulate. Are you originally from there? Has your spouse been married before? Are you first cousins?
  6. You’ve only met the one time? Nigeria is a very high fraud country when it comes to US immigration (potentially the highest). You will have some red flags to overcome so that the consulate doesn’t think you’re just after a green card.
  7. OP, between your previous thread and this new thread, what have you done to address the consulate's concerns that it is a fraudulent marriage?
  8. Great advice. A major mission of embassies abroad is to help citizens to repatriate when needed. Many will even loan you money for a ticket, and I would think Germany would be one of those, with a strong social welfare program.
  9. Are you aware that there is an optional checklist/instructions that accompany the I-129F that you can print out and use to help you fill out the form properly? Strongly recommend it. Doing your research and legwork now may help prevent wasted time and money later in the process.
  10. You need to learn about family preference visa categories. The visa availability has nothing to do with the service center (even if it did, you can’t ‘choose’). Best bet is to research how the visa bulletin works. She’s in for a very long wait.
  11. NVC doesn’t process I129F petitions, it simply dispatches approved ones to consulates. You’ll want to research specific interview wait times for your consulate.
  12. That’s like asking how long is a piece of string.
  13. https://www.uscis.gov/administrative-appeals/aao-decisions/aao-non-precedent-decisions?uri_1=29&m=All&y=All&items_per_page=10 Vast majority of the decisions are denials of the appeal.
  14. However, it is true that there are LOTS of false and frivolous VAWA claims. You can read loads of appeal denials on the USCIS AAO decisions page.
  15. Applied for DACA on the basis of being abused by his USC son? Wouldn't that be VAWA?
  16. Yes, I think you should. He is old enough to understand. It is similar to how adopted kids deserve to know they're adopted.
  17. Good questions. Hopefully the stepchild realizes you are not his/her bio father? I very much doubt the CO will ask anything related to the bio father (name/DOB etc), since that info would be in the record, and that person has not been part of child's life. My impression is that interviews for children are nothing like interviews for adults. The kid is only there due to the choices made by a parent. CO may want to know generally how things are between the child and you, and what he/she thinks about moving to the US.
  18. This is precisely why you should have both read and educated yourselves on the process and eligibility to file petitions. Why is the USC not in this thread? He essentially petitioned you before he was legally divorced. You've wasted so much time and money, you BOTH need to really understand these processes before proceeding.
