  5. That income is marginal for a family of 4 to live on in the US. Potential income of the immigrant is not considered in the calculation, but your wife’s ability to work in the US as a CPA could be viewed positively as part of the totality of circumstances.
  6. What do you mean? How would you take your wife to the US without a visa? She will need the green card to work.
  7. You will need to show evidence of having actually moved to a new state. Simply getting hold of an address and applying like that is not adequate.
  8. Certified copies are considered to be originals. For most vital statistic type documents (MC, birth and death certs), the owner of the document is the jurisdiction where it is filed, such as your county or state. I would get an actual certified copy (vs a photocopy or electronic copy). It will have a seal of the county clerk (or similar) in wet ink.

Fiance will not be able to leave/return to US or work until the AP/EAD documents are in hand, which can take up to 8 months when filed for concurrently with the greencard application. Major drawback to that visa vs a spousal visa.

  15. Yes, give her legal name. The A number would have been printed on the visa in her passport, as well as referenced on correspondence she received. If you don’t have it, it’s acceptable to write “unknown.”
  16. They no longer issue indefinite B visas, AFAIK. If she is approved, they will affix the currently used B visa in her passport.
  17. Were you “introduced” (even if remote) by friends or family also from viet nam?
  18. Apples and oranges. Income that doesn’t ‘count’ for immigration purposes is still taxable.
