Btw, if you are thinking to eventually petition him, you’ll want to have a solid plan in place to pay for his health care here in the US. Being that he’s already 70, he may not qualify for Medicare until he’s 80 or older. People in that age group are high users of the health care system. You’ll want to plan on paying $1k+/month for insurance premiums, not including the out of pocket.

Have you looked into getting medical insurance here in the US? Affordable Care Act? Not sure what your employment situation is, but certain types of employers are known to offer excellent insurance, such as hospitals and city/county/state offices. So sorry for all you’ve been through. Hang in there and best luck.

Without the other forms mentioned, she will have to wait until receiving the GC to work or travel. Current GC interview wait times can be 18 months, depending on your local field office backlog. Why didn’t you petition her properly when she was in NZ? If you also file for the work permit and travel document, it will still be at least 8 months before she can work, or return to the US if she leaves. Is she okay with not working for that long?

Why not just order a certified copy of the marriage certificate??? USCIS will not accept some foreign ‘report of marriage’ in lieu of a legitimate marriage certificate.

Plus, travel medical insurance does not cover routine stuff that a tourist should have taken care of before departing for their vacation. It is for catastrophic coverage.

Why would someone on a visitor visa who had never paid into the system qualify for Medicare??? Those are chronic issues that do not require US-based specialty care- there is no “emergency”. Just petition him for an immigrant visa and wait your turn in the queue like everyone else.

They will be asked who they know in the US, and the purpose of their trip. Why would you ask them to lie/omit this info?

Also - you are adjusting legally. You are in a genuine marriage, and you have the right to adjust status via marriage to your USC spouse. If they question things, you can always reapply with better evidence. You have nothing to hide, so be confident.

That's kind of the deal you sign up for when you adjust status. Again, I don't think you are in a bad place with your evidence. Let us know how you go.

I don't see any issues with your bonafides, to be honest. The tax return amendment is a good idea. Family/friend affidavits are okay, but not strong evidence. In terms of banking, can you open joint no-fee credit union accounts? That is what my spouse and I did. Are there other joint bills or accounts that you can show as evidence?

That was not USCIS error, and it was rightly denied. They are not required to send RFEs for missing documents. Best advice is to just refile.

Totally get that. Is her daughter coming along to the US as a K-1? You can either try to delay the interview by contacting the consulate directly or.....depending on the length of the treatment plan, you can delay departure because the visa will be valid for six months from the medical exam. You could potentially drag things out this way by 8 or 9 months, depending on how busy Spain is for K-1 interviews. Have you guys received 'packet 3' yet? I'm not sure about Spain specifically, but it usually is sent to the petitioner's email and contains info for the beneficiary related to scheduling the medical, interview, and a list of paperwork the consulate wants. I’d definitely try. Sending translated documentation or a physician’s letter summarizing the treatment timeline along with your request could be helpful. PS: I am an oncology RN. Kids her age usually get through the treatments well. Take care.
