  1. Yes we applied on January 6th, 2022, initially we got the 24 month extension, but just today we received the new 48 month extension letter in the mail! I guess USCIS is slowing sending them out now!

Since the filing overlap for the I-751 and the N-400 is so close (1 year apart) we are going to take the entire 751 package, items after the filing of the 751 (these will also suffice as items for the N-400). The N-400 interview NOA states that if you submitted copies when you filed the N-400 online that you should bring the originals to the interview. @Crazy Cat stated that the IO they had for their combo interview specifically asked for items from the date of filing the ROC to the combo interview, so that's pretty cut and dry there and how we made our decision on what to take. Our local office is the same as Crazy Cats so we were tuned into that statement Crazy Cat made! Items we are taking to the N400 interview : Copy of the entire I-751 package (never know what USCIS has done with your original and it's better to have it and not need it, than to not have it and need it.) This is all in anticipation of having the Combo interview, also there are items inside the I-751 package we can use for the N400 interview too. Copy of the entire N-400 package submitted online (ALL Originals as requested) The N-400 items will also serve as items from ROC filing to N-400 interview. I know its very confusing and a mountain of paperwork, but if its a Combo interview I will be there to help the wife navigate the ROC portion (which is the largest of the packages). The N-400 portion she will be able to manage by herself as it is a much smaller package. Might be overkill some will say, but this is OUR personal choice as I have learned to be prepared with USCIS throughout the years. We started this journey with the kitchen sink with the K1, no need to stop now as we might as well go out with the kitchen sink too! Since this will be our FIRST interview together, if it's a combo, (AOS was waived) we have little to no idea what to expect thus we are going to go armed to the teeth so to speak! Just sharing with you all what we are going to do, we understand to each is own so please respect that as we do!!!

  7. Yeah do that I've seen folks on here do the same thing and once the IO found out the spouse was there it turned into a combo interview. So maybe whoever the interviewee is might be a good idea to lightly drop the hint that the spouse is outside.
  8. OK cool we'll keep an eye out for it if it should arrive. Now I am scrambling to get everything in order for both the ROC and the 400. I've got mountains of papers in two separate boxes I have to organize and then go on my pc to get others to put stuff together to take to the interview. I kept records but they were not kept in order. I got kinda lazy at the stretch line and just threw stuff in the appropriate box. I do not recommend that!

  10. It just dawned on me that I could look in the documents section in the online account and get the NOA of the interview date DUH. Interview date is April 11, 2023
  11. Status on my wife's N-400 changed to "Interview Was Scheduled" on March 7th, 2023, we are awaiting the hard copy in the mail to tell us the date and time of the interview. No word on the I-751 still showing that the fingerprints were applied to the case. Hopefully this will be or turn into a combo interview. We will plan as such and take all documents for both forms. I of course will accompany my wife to the N-400 Interview in the hopes that it'll be a combo! I-751 submitted January 6th, 2022 N-400 submitted online January 5th, 2023
  12. Yes you are correct there is a question on the N-400 that asked "Have you EVER claimed to be a U.S. citizen (in writing or any other way")? Part 12 question 1, it also ask for an explanation on a separate sheet of paper if you answered yes, so you'd have to explain it there. I'd be proactive now and in addition to amending your taxes I would get a affidavit from your tax preparer stating what happened and include that with your N-400 documents. Not sure if it will be an issue, but one thing we do know it will be an issue if you fail to tell the truth and they find out otherwise. Your proactive steps taken now I think will save you heartache when the time comes.
  13. @aapl also visit some of the other I-751 threads and look and see what everyone has done and use them as a guide for yourself. I filed my wife's in January 2022 there are excellent ideas given there if you care to look. Any I-751 thread will do though especially if there is a lot of content inside. Slow down and make sure you are in your window!
  14. @aapl No reason to send two checks you can combine the amount. Unless you have a specific reason to send two checks one will do! You did not list taxes, bank statements, utility bills, rental contracts or mortgage statement (unless that's in your proof of legitimate marriage you mentioned). I'd slow down and check your packet before sending it. If what you listed is all you really are going to send I think you'd be in trouble. USCIS does not recommend two hole punching it used to be the thing to do but they changed their language. I do not think they would kick back your package for doing it though. Make sure you send tax transcripts if you can get them or have them

  16. I know you've gotten a lot of confusing answers some say you do not get the new extension letter for the N400 some say you do. Not sure why that happens. But I can assure you my wife got both extensions on her NOA for her 751 and then another for her N400. Just file your N400 and see what happens and go from there. The extension is not an update though they are two separate extensions one for the 751 and another for the N400 they overlap which gave us an additional year after the 751 extension will expire. They both are for 24 months!
  17. Looking at my NOA for my N400 and as @Mike E said filing the N400 does automatically generate another extension letter. I got a 24 month extension for the N400 as well as the 751! Not sure why others have not, but its true they do issue one.

  19. Plus they will want you to pay next years taxes quarterly, its not required but they always suggest it. Yes the underpayment penalty is going be substantial!

Our window opens up January 3rd and we will be filing January 6th. Our ROC is still pending and was filed on January 6th 2022. Good work everyone getting to this point in your journey. Hello October 2022 AOS filers another month another round of AOS submissions, Please be aware that this checklist is NOT all inclusive and you must consult the USCIS website to crosscheck this checklist against/with. The AOS process has been confusing since the pandemic hit, not to mention the added politics. So please I want to stress that you only use this check sheet as a starting point and guide if you will. The USCIS site will be the final guide. Please ensure that you check your forms for the correct versions and editions because if you use the wrong forms USCIS will reject your application and send it back to you. This is easily checked on the USCIS website prior to downloading your forms. You should also ONLY download your forms from the USCIS website. The current and correct fees can also be ascertained from the USCIS website . Just a side note before we get started USCIS may decouple Forms I-765 and Form I-131 if filed jointly with Form I-485. Here is the quoted text taken directly from the USCIS website. "To improve efficiency and reduce Form I-765 processing times for Form I-485 applicants, USCIS may decouple Forms I-765 from Forms I-131 filed at the same time. Effective Feb. 1, 2022, when possible, we will adjudicate an applicant's Form I-765 first. If we approve it, we will issue an Employment Authorization Document without any notation about advanced parole. We will adjudicate the Form I-131 separately and if we approve it, we will issue an advance parole document". I know this is old news, but I thought it would be good to include it here for your knowledge. What this means is some people elect to include three (3) copies of their marriage license / certificates one attached to each form (I-485, I-765 and I-131 respectively). I do not know of anyone receiving an RFE for a marriage license/certificate missing on the I-765 or the I-131 since USCIS has started doing this new way of adjudicating the AOS (the marriage license / certificate with form I-485 is required though). This is an age old concern that has been in play before this new way USCIS started adjudicating these forms. Some filers including me when I filed the AOS back in 2019 sent in three (3) copies of their marriage licenses / certificates. I did it then because of peace of mind and there were some RFEs given out for missing licenses / certificates (back then). USCIS also used to issue Combo Cards, Employment Authorization Document and Advance Parole (EAD and AP combined in the same card). I've seen now where they have issued an EAD without the AP. Whether you include three (3) copies of your marriage license / certificate is going to be your individual call when you file your AOS. Having said that let's get into the checklist: AOS Checklist Cover Letter listing Table of Contents Check Payable to U.S. Department of Homeland Security - $1,225.00 (this includes the Bio-metrics fee) Form I-485 (completed and signed by non-US Citizen/beneficiary) Form G-1145 Copy of beneficiary's Passport with biographical page Copy of beneficiary's K1 Visa from Passport and entry stamp Copy of NOA2 Approval letter (from K1 process) I-94 Copy of beneficiary's Birth Certificate translation of birth certificate (if needed) Certified copy of Marriage License or Certificate Passport Photos (2) name written on the back Copy of DS-3025 Form I-864 (completed and signed by USC) (goes with form I-485) Proof of USC's citizenship (copy of birth certificate, copy of passport bio page, or other) Current tax year 2021 and (optional 2020 , 2019) Tax Return (with W-2) or Transcripts (transcripts are better if you can get them) Employment Verification letter (updated one - not the one used during K1 process) Pay stubs (last 3 months) Form I-765 (completed and signed by non-US Citizen/beneficiary) Copy of beneficiary's Passport with biographical page Copy of beneficiary's K1 Visa from Passport and entry stamp I-94 Passport Photos (2) name written on the back Copy of NOA2 (from K1 process) Be sure to use the correct filing code of (c)(9) if this code applies to you. The I-765 instructions explains all the codes in detail. If you are filing under a different code (other than (c)(9) the fee for your AOS will not be correct and USCIS will reject your entire packet. Form I-131 (completed and signed by non-US Citizen/beneficiary) Copy of beneficiary's Passport with biographical page Copy of beneficiary's K1 Visa from Passport and entry stamp I-94 Passport Photos (2) name written on the back Copy of NOA2 (from K1 process Be sure to double check for the current fees as fees do sometimes increase and they can change on a dime so please check. Additionally, check the forms as listed above i.e., current version and or edition date, there have been many changes to various forms. Consider sending tax transcripts instead of the 1040, and W2's. Also consider preparing a cover letter for each form in addition to the main cover letter. Make sure you send long form birth certificates and not the short form. Hope this helps in your preparation of your AOS. When in doubt ask questions. Please consider filing the I-131 and the I-765 even if you don't think you'll need them right now. You never know what changes your life will have on down the road, so I recommend you file these two forms from the start. There is no extra charge to file them with your AOS and it's better to submit them all at once. There has been much confusion coming out of USCIS, partly due to Covid-19 and partly self-inflicted. This confusion filters on down to the people filing for AOS.
