You were very right on the long stay, in waiting for an approval on siblings.

I have a very good friend who applied for her brother from the Phil's. He died unfortunately after waiting 21 years. This is so sad, as his petition was approved at the end of 22 years.

She inquired if this was a norm, and unfortunately was told by the embassy that this was quite normal. Especially the Phil's it is basically half a life time in wait, due to the huge numbers who come here.Each year only so many Visas are granted to the Phil's as is with all countries. But in so many coming from the Phil's on other Visas, they are taken and used up, and others in wait for family members are often left behind for good. Sad state of affairs, but true. Many have brought up the subject in saying that it is the people who bring spouses and fiancees over that are to blame for siblings being left behind. We use up those Visa allotments and they are over looked. I guess there is reason to look on that thought as true, but I would never for a moment give up a lifetime of happiness over it and choose not to bring my wife here. Just a thought, for you. Best wishes to your family, and to hers, and hope she finds happiness where she can,and with you, and not have it over shadowed by guilt.

To All Having Interviewed This Month:

As several questions have arisen in several other topic areas about the Phil's.

I have a very good question. With the delays of the last year, and with all the problems having arisen due to all the changes that have created delays, has anyone been asked for this years (2006) tax returns thus far? Lorelle (Aussie) and a few others have made it known that it has happened before, and at this point in saving many a trip to the embassy to be saddened in arriving without knowing it, do we need to bring New transcripts with our loved ones to the Interview, will this be a problem?

Just was wondering, and hope it really isnt a problem at all, and just me being a worry wart.

As they had said, you dont need your letter if you have the copy of the NOA2, and such.

But as it says onthe NVC hot line(Automated) if you have not received your papers within 8 weeks, it asks you to press 0 I think if I remember right. Let the message play to the end. I just received mine yesterday, took a month. If you want to see what packet 4 and the appointment letter look like, I uploaded it on to my web site in it's entirety, including the Tagalog Version they send.

Hello fellow worriers! Ha! My wife Grace and I are in the same situation only her interview date is March 28th and neither she nor I or our attorney (Holmes and Lolly) has received any official notification, letter, packet, just nothing! Yet the app't date for our case number at the manila interview site is March 28th, 6:30am, and of course it also lists the st. lukes app't date 12am March 28th. We're starting to get concerned! I already have my plane ticket now arriving there the 26th. I sure hope we can get a letter or csomething soon. She tried calling the Embassy in Manila, that's a joke. Do they even bother trying to be helpful ever?

Hi Boo,

Aloha is right, you can go there even without your packet yet, just bring the copy of your NOA2. Or you can call St. Luke's and tell them you will request to pick-up your packet with them. They will either call you back or you may need to call them back if they already have your packet from USEM. Then you can schedule your medical exam.

Do you have the number for St. Lukes or Embassy call center? Beneficiary can call them or only the USC can call them?

If you go o this web site page for the Embassy, it has all the numbers and addresses.

I hope it helps you out, it pretty much explains what is what right on there.

And when it says they assess a charge to call, it is 18 or 20 doillars, I cant remember, but not cheap.

It is so nice to hear that the embassy appointment is the interview date.

I guess i am so floored that is so soon. Here I have been thinking July by reading so many time lines in the past, and maybe that was a mistake. But now I am glad I read them , and realizre that things have changed such a great deal in just the past year. So in expecting a date much farther out, now it is next month....Wow!

I guess i will be in a mad rush to get all the required documentation together much sooner, and hope I dont forget anything. So now I had better get ahold of my wife and let her know, she is surley going to cry in her joy in knowing it will be much sooner, and I just sent her off to school to keep her busy. Oh well...it was an effort of love to keep her mind busy. I will pray for all our destinies to be fulfilled, and pray for all those in AR, and pray we will not be in the same boat for any reason. I just went to the Manila Web Site and punched in our case number to see if they had posted anything yet

as to Medical and or Interview Information.

When it popped up with some information, this is what came up.

I guess I was just wondering what the Embassy Appointment Date refers to.

It is posted with the same date as the Medical, and before the time posted for the Medical as well.

What is the Embassy Appointment Date and time, and what is it. Is it the same as the Medical, and just two different times for the Medical? Just trying to make sense of it as 12 AM is Midnight if I am correct. Do they really do Medicals at Midnight? I am really confused now...dont get it.

So just wondering, any thoughts appreciated.

hi gary, what DFA told ur wife in regards to CFO is correct. my wife had to attend cfo before she could change her passport. My wife said that it will be listed on the back of the passport app what the requirements are to get a new passport due to name change. of course thats not to say that other people won't have different experiences with this procedure depending on who they talk to, but my wife specifically attended cfo to get the new passport and she remembers it being listed on the back of the app. take care, it gets easier as you get more along in the process and before you know it Fely will have her interview date! good luck!

Thanks soul. We're going ahead with Fely attending the CFO, but not until our 6-month anniversary which was also what they "suggested." Meanwhile Fely has been told by a friend whose daughter came to the US on a K-1 visa last December, that the cost of the CFO is 9000 PhP. I have no idea where she got this number from, as I know it's only 400 PhP. But I'm having trouble convincing Fely of the real cost. Does anyone reading this have any idea where the 9000 P amount came from? That's about $180, which is the fee for the original petition.

I got an RFE asking for:

"Federal income tax returns for the most recent tax year or certified Internal Revenue Services (IRS) copies."

Before we filed our 2006 tax (1040) we made copies in case we needed them. My question is can we send a copy of the tax return that we filed or do we need to get a certified copy or Tax Transcripts from the IRS?

Is there anyone that just sent a copy of their tax return without a problem? We have not yet received our Income Tax Refund so that means getting a transcript would require us to first wait for the actual refund to arrive (so the IRS will have processed the return and have a record of it) and then contacting the IRS to have them send us a transcript?

Any help or advice is appreciated.

Xerox copies are acceptable, you DO NOT have to have them certified.

The U.S. Govt knows you will keep originals, and know you will seb=nd copies, and as phrased in their instructions, they will only expect originals, or certified copies if specifically requested.

Good question about weather to send in a I-129F for a K3 visa or just wait out the I-130 Petition. We are in the same situation. From all the information I have seen, it really seems to be mixed bag. Some people are having their I-130 processed really fast (6 months until visa is issued) and others seem to have to wait an extremely long time. I just looked at the timeline on this site and it said on average it will take over 250 days from the time your NOA2 is received until you get the actual visa. It probably wouldn't hurt to just send in the I-129F petition, just in case INS looses something with your I-130 or there is a hold-up with it for some reason. The only downfall to sending in the I-129F, it seems, is the additional application fee you have to pay. Otherwise, it seems like it makes a lot of sense to send it in, especially if you are in a rush. Two seems better than one to me.

We haven't yet filed our I-129F because for some reason USCIS either lost or never sent us in the mail our NOA1 receipt. We were able to get our receipt number from the back of the cashed check and with the help of an immigration officer (over the phone). However, we still to this day have not received the NOA1 in the mail and they said it may take 40 to 60 days for them to send out another one. We can not file the I-129F until we have the physical NOA1 to send in a copy with our petition. The immigration officer said he wouldn't advise sending in the I-129F without a copy of the NOA1. It really sucks. So, depending on when we receive the NOA1 in the mail we not not even file for the K3 visa, because our I-130 may be pushing along. We will have to see where we are at when that happens. Any thoughts on this?

If you ask me, it is, and has been a waste for us, not to say it will be for you.

As you see, it seems it always a case by case issue. Our I-130 is complete at NVC, and our K3 was never approved. Even though the date last month said they were processing k3's for july, ours was never approved. So either they lost it, and wont admit, or they dropped it, and seen that we were at NVC with the CR1. Who knows, Lord knows I dont.USCIS makes absolutely no sense, and never has, and as I see it, never will. If you need anything, check out my web site,tell me what you think. You wont have to worry about finding Phlip's there in that part of Minnesota.

And as for your shopping needs from a phil stand point, there is a Phil-Am store on University Avenue and a ton of other Asian stores to make you feel at home.They will know what the local groups are, and where the Phlip's as they call them here hang out. I do all of my shopping on University, Nicollet, and a few other places there. You will find Pansit, Balut, and all your favorites all over in the Twin Cities. We have a huge Phil-Am group south of you in Rochester, and there must be a Phil-Am group there in the cities.

So Mabuhay....Hope you like it here, winter is nearing the end sort of, and the worst is out of the way mostly.

Hope you learn to adapt as all the others have.

Just wanted to let Everyone Know!

Our case was not updated in the phone system till last night when I called the folks at NVC.

I do not mean to be a stickler for detail, but ...

Police Certificates ARE required for the Philippines in filing for the CR1 Visa.

You can take my word on it, and i have the letter posted on VJ proving it.

If you do not have the Police certificate...you will receive an RFE for it.

One must go to the local authorities in the respective cities that the beneficiary has lived and ask to have a Police Certificate for purposes of travel abroad to the U.S. and MUST have a picture either scanned at that office onto the certified document or in some cases a passport photo is attached to it due to a lack of modernized systems and procedures at particular offices within the Provinces. They MUST also have a Right Thumb Print on the Document which has been done by buying an ink pad and doing it yourself in a squeeze as has been done by others (Not Recommended) but do-able, or having them do it for you at the respective office. Thse vary in color, size, and paper quality ,alll dependent on the Province in question. If you wish to see the actual papers (Police Certificates) and how they vary, you can e-mail me and request copies of what they look like. I received an RFE for being told I do not need them...YOU DO! I will be glad to show them to you on request. If in doubt, all the info is posted on my personal web site.

No There is not a problem with using this document.

It is simply a formality, and more and more no one is using them anyway. Still send it in, but use the short cut, and e-mail them. This is the most efficient use of time, and will get a result faster. It is also on my web site. If you go there, I have created a link with the wording and how to do it. Good Luck, and Just check and double check, and check everything ................again, before you send.

You will be glad you did, and even have some one else look at it to catch some thing you may not notice..

We received the NOA2 for both our I29F and I30 on Friday.

The I30 has my name as the petitioner and my wifes name as the beneficiary.

But... the I29 has my name as both petitioner AND beneficiary.

Uhhh....

Is this right, or do they think I am married to myself?

You must as expected, get ahold of the U.S.C.I.S. first and foremost and let them know. But if it is being sent already to NVC, which might be the case, but this soon....who knows. I would call NVC and see if they can give you an answer as what to do if it is making it's way there and soon to the embassy. As it is their mistake, it must still be fixed by them, but must be initiated by you to do so.

There is no policy stating how it has to be placed on the top, it just states in the packet, that your case number must be written clearly and legibly on the top right corner of all documents. As has everyone else that I know, including myself, I just hand write the case number. It need not be a certain size, certain script, that is all just detail. But be sure to write it big enough for them to read easily, I just wrote the same size as the case numbers they placed on the forms. So if you have any others questions, I would be glad to help, if i am able. It's nice to see others willing to ask and to help other people.
