    I did not file for N-400 either.

    i changed my address online two days ago and i put in both receipt numbers in two slots for the change of address ,for both i selected I751 . it gave confirmation numbers for AR11 (step 1)and Service request (step 2). Said something about receiving some mail by feb 2018 for the address change confirmation.

    OMG. Cant wait! its been 3 years since i came and havnt gone back to home country yet. i guess i am just waiting for 10 year GC.  We are moving this month to our new home here in MO. United states postal service has been updated of address change , but i and my husband still need to update USCIS.  But its feels great to see CSC moving!  Congrats to those who are approved . My case was received on 09/16/2016.

  4. First of all there are so many layers to this. We are all trying our best to assess assume the people involved and their intentions. If her husband truly does not care about her and is black mailing her by booking and cancelling tickets then she should call it good riddance and get a divorce , i know she has to face her family but i am sure in the long term this is healthy and if they understand or not now , they will understand later. This is a very difficult time for OP's friend. I feel for her.

     

    One option is go back home and face the challenges there. and the other option is to find a legal way to stay here and get a job and start a new life if she can handle doing that away from family and friends.

    But if she just needs sometime to reorient herself then until her legal state expires she can stay with her friend and then move back to her home country where she has support of family even though they may not understand her divorce , i am sure they will understand that one should have to get out of an abusive marriage .

    So , she may have to face challenges when she goes back , but atleast she wont be in toxic relationship and she will be free. All this idea of alimony will only make situation very complicated in my opinion.

     

    Now we need to understand that we dont know much about her husband's point of view. What if he thinks he made a mistake and is deciding to end it before he is dragged into a legal obligation to support ? Obviously he hasnt uprooted his life and moved to another country trusting his spouse so he may not be feeling what she is feeling and yet he has a right to decide for himself. Its hard but people can change their mind and they have a right. Its  a hard lesson for both . Especially emotionally more so for OP's friend. Our thoughts are with her. All will be fine one way or the other.

     

    From what i am reading , since her applicaiton is not yet approved and is in the beginning stages , one has to make sure if her husband can pull his support or not , will uscis consider him withdrawing his support at this stage or not. that is the first step. If he can , then she has no other choice but to go home , but i am not an attorney so i may not know all the options here.

    Thanks for replying and Thank you for the link ! It also says that US CITIZEN spouse who sponsored I-864 has to complete form I865 for change of address as a sponsor? So i have to complete AR-11 online ,two steps , and my husband has to complete I865 and mail it , correct?  There is no Phone involved here? Can i865 be done online as well? Also , we will be moving by JAN end. Can i go ahead and update address now. ? we have keys for both mail boxes. So checking our new house mail is not a problem. Just want to make sure if i am following all the official rules here . USCIS says with in 10 days of moving. I would rather get it out of the way before moving .lol

    Yes. people often think ,'oh its USA ! one  is here for green card' etc. i think its a kind of arrogance to think that everyone is who comes here trusting that a marriage may work out comes for just that. its not so important when you compare it to what a person might have left behind to come here . Their  life before moving. which may be a  huge change. job, family and  in asian countries there is something called honor when you marry and go with your husband etc etc. its hard to describe. its not all about money or green card. when one's marriage does not work out and they have to go back not only they have to reorganize their entire life financially like getting back to where they were before but also face family and friends who may or may not understand divorce. Again. irrespective of all this if one is better off finding comfort and support from family then one must go back. but if they have a legal help to stay here and face the challenge then they should take that opporunity as well. After all they are not some pawns of a chess board to be shifted from one place to another based on someone else's moods. i guess thats why they Divorce waiver etc in place but in this case unfortunately its too early

    Yet again someone posting for a friend. Had the person in question posted themselves we could have saved at least 20 posts where we were trying to work out if her AOS was merely accepted or actually approved. I suggest your friend creates her own account so that she can give accurate information and we don't have your random guesses to work with. 

    I think the cultural differences playout big time. In usa its easy to get married and divorce frequently. But in other countries marriages are often a lifetime thing. Lots of trust and invested emotion and family in there. Huge cultural value difference when it comes marriage . For us citizen spouse it may seem like normal change but for other country spouse this may be a change that can turn everything in their life upside down. 

  8. Guys i need your help. I am sep 2016 csc filer and me and my husband are  moving next month to our own house from a rental property .  We had joint lease and stayed here ever since i came to us and now we are moving to our jointly owned house.

    Please educate me , what is the process to update uscis of the address change? . Do we both need to separately update using different forms since we are  the petitioners of  i751 and he is the sponsor as well. ? What forms do we need to submit , can it all be done online or are we required to call? Is this a simple quick process? I am just disappointed that CSC is so slow. Its been more than a year and they havent touched our cases. I feel like now i should apply for citizenship but we are moving to new place and all so its gonna take some time. Please help. I appreciate your time. Thanks!

     

    I want to do it all online without having to call but if there is a requirement from uscis that we must call ,we will. Please guide me as to how to proceed , what forms to use , where to start?  Thank you

  9. Thanks for your feed back guys. When i think about all of this limitations just becoming a citizen feels like a good plan. Lol. Btw we got our quit claim deed notarized today and it will be recorded with the county clerk sometime next week. We will moving to our new house next month.

     

    Now another headache is notifying uscis of address change while my i751 is still being processed.Where can i find the step by step guidance as to completeing this process of notifying uscis?

    My husband and me ,do we both need to notify separately ,i as i751 petitioner and he as the sponsor of affidavit of support?  I very much appreciate if you can give me the specifics if you have had experience with notifying uscis of  address change  while an appication is being processed. Thanks!

    This could mean that until we sell the property , quit claim deed claiming the property as joint may not be considered as gift ;). Oh well i will research some more. and ofcourse will talk to cpa before filing our taxes. Meanwhile keep your valuable feed back coming

    For Income tax,  no taxation difference between USC and PR , i understand . Is it so for estate and gift tax ?. BTW i am aware estate tax has usual 5.4 million exemption for both USC and PR spouse but i read online when i search on google that gift tax are a different ball game. It has some sort of low exemption amount for a PR and perhaps unlimited for USC spouse or something. May be you are right. i am still researching and finding all kinds of different answers.

    If the spouse to whom real estate is gifted via quit claim deed is US citizen then i assume there are no tax implications and perhaps no issues , but for resident alien there could be, i am not sure. I want to know if anyone else has directly dealth with this or has any knowledge about this , what is the exemption amount etc.

  14. I am in the middle of removing conditions on my residency and i am september 2016 CSC filer. So like all others i am waiting and got my I551 stamp extension of resident status in september 2017.

     

    This month my husband is adding me to our house through quit claim deed , we live in missouri. Now i dont know much about gift tax implicaitons for a resident alien, i understand that IRS views quitclaim deed to spouse as gift  for tax purposes. This house was inherited by my husband via beneficiary deed from his mother after she passed away earlier this month. Its worth 225K , so anyone here has similar experience and any knowledge about gift tax implications , exemptions etc for resident aliens? We file taxes jointly as married filing jointly , have done so for 3 years.

     

    Please let me know if you know anything about this.

  15. Btw op, i found this on the USCIS website. Among the few reasons for expediating waiver of idmissibility this is clearly listed.

     

    41.7 Expeditious Adjudication of Waivers  of  Inadmissibility.  

     

     

    'The applicant’s qualifying family member  is a member of the military who is deployed or  will soon be deployed;

     

    and

     

     The applicant demonstrates that, in light of the deployment there are compelling reasons to expedite the request due to  the impact of the applicant’s absence from the United States on  the applicant, the qualifying family member, or their children, if any'

     

     

    This is exactly what your situation is , so that is why USCIS has assured you of expediating your waiver :)

  16. I sincerely hope that it will be expediated and your wife can be with you and kids in a month or two . If any one's situation deserves it ,its yours. I know immigration can be complex topic, especially without a good attorney. Most of us without a lot of money to pay attorney fees learn from sites like Visajourney and have successfully filed our petitions and obtained visas and greencards, naturalized etc. And i commend you for keeping your calm and levelheadedness even when some here were talking harshly without a sense of empathy. Good luck to you and your family OP. please update us.

     

  17. So sorry that you and your family is going through this . I can only imagine how hard it must be for you and your wife and kids to deal with all this. Us government should make it much easier for service members since you are giving your life for the country and have family to take care of. 

    Still, dont worry. Follow the suggestions given in this forum also research online about waiver and consult an attorney if need be , in the end i feel strongly all of you will be together. Just file the required paper work and may have to wait few months before the process can complete. Good luck and my best wishes to you and your family.

    I only got the international version of our marriage certificate. I think military wanted a copy as husband was in the army but other than that no one has ever needed to see our marriage certificate. 

    Thank you for your reply. Good to know that it is enough. So there are no issues when it comes to transfer of property , Spousal IRAs etc using our international marriage certificate , correct?  The courts here recognize it without creating problems for us?
