  1. Got a call back from USCIS this morning at 6 am (they were suppose to call me yesterday). I had the officer check in my EAD and she said that that the case was approved and is in production! AMAZING news. Over the moon. I am still not able to check the case online though, did others have this problem? I'm just hoping that this officer was right! Based on others' timelines it looks like it should be here within a week. There is hope y'all!

  2. Last week I called USCIS and got transferred to tier 2 and finally got a call back. I was hoping to put in a service request or something to get my EAD/GC moving but was told that they can't do anything because I already asked for an expedite request (which was denied) and they couldn't put in a service request because 3 weeks hasn't passed since they've received my RFIE documents. All of it seems so arbitrary, who makes up these rules? My current EAD expires on the 12th of July, I was really hoping to keep my job. Don't they realize how much this stuff affects our lives? :ranting:

  3. Hey, has anyone rang up USCIS about getting a service request on their EAD when they have had a RFIE? Just curious what to say if I do so, should I ask to be transferred to Tier 2?

    I have, I even put in an expedite request for my EAD while gathering my materials for my RFE. My expedite request was denied and they sent me a mail that said that my EAD was on hold because of my RFE for the adjustment of status.

  4. I paid for a lawyer also I primarily deal with his assistant she is very informative if she can't assist me or wants to double check something then my lawyer will call me... I think it's normal for there assistant/paralegal to prep the paperwork and everything that's who done mine he just went over it to make sure everything was where it should me... Have you tried talking to your lawyers assistant? When I need to talk to mine I usually get a returned phone call or email within 1hr and very promot with everything

    The assistant that I was working with left and I wasn't even told that she was leaving so I dont really have a point of contact anymore. Your lawyer/paralegal sounds way more responsive than mine.

His legal assistant did most of the work in getting our documents together and sending it in and stuff. But he's just turned out to be such a flake. Not really answering my questions, when he does he only answers in one sentence. It just feels like he doesn't care about the case and has never reached out to ask me how I'm doing or anything. Even in submitting my RFE response, he didn't help at all and I had to do everything myself. The legal assistant who was helping us also ended up like leaving and they never told us about it.

    Long story short, he's not helpful. I'm paying him a lot of money and I just feel like I'm not getting any support from him. Has anyone ever been in a situation with a crappy lawyer?

  7. ...And "just" like that my case status for my EAD was magically updated to "card being produced" haha I guess it was just sitting in a pile. I'll definitely be submitting a service request if I haven't heard anything in regards to my GC by July 17 as stated by the officer. Seems like it works!

    Sounds like a lot of april filers are hearing back and getting scheduled, that is keeping me hopeful!

  8. I'm in the same situation! It's really weird we haven't heard anything yet!! I don't know who to call though.. :(

    aww man that sucks, but they sent you an email saying that your ead is approved and being sent? maybe that's a good sign! they're getting stuff done but just not on top of it with the notifications...

    Yeah, I'm sorry.. I haven't sent it like you, so I don't even know if it's been delivered. At least you know that! Someone has got yours! :)

    I also don't know how calling helps or not.. I think we just have to wait. The thing is that maybe it's somewhere on a desk and nobody has even touched it yet..

    I got a letter saying that my ead card was on hold because of my RFE for the adjustment of status so i think if your ead card is being produced, hopefully they'll notify you about your interview or something soon!

  9. Heh my father-in-law is living in our house, so technically yes lol. I don't mind it much though, we have given him 1 year from when we got married to find his own place

    ckibs, have you heard anything since you've submitted your RFE response? I just sent mine off on monday and they just sent me a text and email notification, for the first time, saying that they've received it and will start processing. Maybe you should call them if you havent heard anything.

  10. I think swizzle9 was referring to my post a couple of days ago. The Tier 2 was a 100% positive about the fact that I-485 and I-765 are processed separately. I also mentioned the Tip Sheet (your link) and he repeated again that they are processed separately and my RFIE on I-485 doesn't impact I-765 at all. But it might just be my case and not a general thing...

    Moreover, when read carefully:

    • For example, if your eligibility for employment authorization is based on a pending Form I-485, Application to Register Permanent Residence or Adjust Status, and USCIS issues a request for initial evidence pertaining to your Form I-485, the clock for your Form I-765 will stop when USCIS issues the request for evidence and restart when USCIS receives the requested information.

    It just states that the clock will stop and restart when USCIS receives the requested information. Legally, it just gives them more time to process before you're allowed to file a Service Request upon the 75 days limit. It doesn't say that they stop working on the I-765 while waiting for RFIE I-485 response, so anything is possible I guess...

    My RFIE delayed I-485 by 2 weeks exactly. So we'll see if i'll effectively get my EAD/AP end of June (as estimated by VJ) or later on July. If the later then RFIE does delay your EAD.

    I was referring to your post but I was also told them same information as you, that the two are separate, when I spoke with them before on the phone.

  11. Ty vole! (a Czech expression when you're mad! :D) That's not good news!! How do you get to talk to someone like that??

    I have to receipt numbers, one of them I can check online and the other doesn't work. I use the receipt number of the one that works and call the customer service center. I'm only able to patch through to a live person through the receipt number I can check online. I tell them that I want to talk about the case with the receipt number that I can't check online, they tell me that they can't find it in their system so they are going to send me to tier 2. Then tier 2 calls me back when they have someone available. I think we're only able to talk to someone if our case can be "found". So silly.

  12. Called USCIS today to see if there were any updates on my EAD because I haven't heard anything from them about the expediting request. They (2nd tier) told me that they sent me a letter last week and should get here this week. He said that my case is on hold because of my RFE for the adjustment of status. I told him that someone else told me that the adjustment of status and EAD were separate and he said no, they can be connected. The officer also let me know that because I'm in risk of losing my job from OPT, this may not count for the financial loss reason to expedite the EAD. He said because the main goal of the OPT is to get job/field experience and not about me supporting myself/family financially, so they might not be able to expedite it. I don't even know what to say or think at this point. Just throwing this information out there to other people who are adjusting from OPT.

I am on my F-1 too as of now, there was a point of time when my EAD card was approved but misplaced by USCIS and sent to my old address...smh it took me another whole year to get the approved one again...I worked as it was approved...However, in most cases an employer will wait for you for about 90 days for you to obtain your EAD card... Some even let you work with a promise to pay you on a later date...

    @swisly9 it really depends on your employer on how they handle it...request them to let you work till the start of July...And I am sure your card will be there even before then (seeing most March timelines).... Well if you have put in an expedited request call them and fax them a copy of your current EAD Card and your current Job and they will.

    My employer is letting me work until my expiration date in July but what's making me nervous is that she's starting the process to hire someone new before I even leave. It really doesn't give me much room to keep my position. She said I can reapply for it but it's just a drag. I'm hoping the RFE isn't going to impact my EAD coming that much... Fingers crossed!

    I’ve been following this forum for a while but haven’t posted yet. I have a similar timeline with most of you. I don’t have the specific dates with me right now but everything was going off like clockwork, until I received that RFE. I still haven’t sent my response because I’m waiting for my joint sponsor to send me their paperwork (hopefully will arrive by the end of the week.)

    I’m really stressed right now. I’m currently employed through my OPT but that expires mid July. My supervisor here told me if I don’t receive my card by June 6th, they’re going to start the paperwork to hire someone for my position. That really bums me out because I really need my benefits ( I have a chronic condition that I need really expensive medicine for) and I really need to be able to pay my rent as my partner is not making that much right now.

    When I called, they told me that the EAD process was separate and that getting an RFE shouldn’t delay it. When I called to expedite it, they didn’t say anything either so I’m a bit confused. Man, I’m hoping to hear something soon because I really don’t want to lose my job! I’ve also been working with a lawyer but he has not been helpful at all, I guess he feels like it is out of his hands right now.

    April 6th - Date filed.

    Mid April - Received NoAs

    Last week of April - Received biometrics notice

    May 12th - Biometrics at 2 pm

    May 18th - Received RFE (Need to resend my tax forms (even though I sent it), a copy of my birth certificate (which I also included) and even though I’m making enough money right now, my partner isn’t so we figured getting a joint sponsor would be a good idea but it’s totally dragging on longer than I had hoped.

    May 26th - Called and submitted a request to expedite the EAD

    Hopefully since everything else seemed to be processed quickly, maybe they’ll process my RFE and send me my EAD?
