  2. Good point. I have seen cases where the I-130 wasn't approved/adjudicated until the I-485 was. USCIS may or may not separate the 2 here.

  5. If she was considered an immediate family member of a US citizen, she could. However, she is an F2B F1 visa category. Her priority date is far from being current. It will be more than just a few years. She cannot adjust status (submit an I-485) in the US unless she maintains legal status until her PD is current.
  6. @Dashinka hit the nail on the head. Be prepared to show CBP your interview letter. IMHO, no person in their right mind would come to the US to adjust status if they already had a visa interview set. I believe CBP is smart enough to realize that, too.
  7. Remember that a Senator or Representative can only inquire about your case. The actual decision for an expedite comes straight from USCIS......discretionary, but based on their printed criteria. Also remember that it costs nothing to request an expedite.
  8. That is what they normally do.....I haven't figured out why wife got only 5 months. People should make sure they are aware of the expiration date, and arrive by that date. Good luck on your journey. It is quite a ride.

  12. The expiration date of the medical exam drives the expiration date of the issued visa. CBP will be interested in the VISA expiration date, and they cannot alter that visa expiration date. Perhaps the intended message was that the Consulate might issue the visa with less than 6 months until expiration. That is true. Example: My wife's visa expiration date was 5 months after her medical exam.
  13. Getting a SSN through submission of an I-765 and/or I-485 has always been possible. However, there are advantages to obtaining one as soon as possible. That is why seasoned members of VJ ALWAYS recommend applying BEFORE marriage. See the instructions here :
  14. To my knowledge, people who submit a proper I-485 are still granted "authorized stay" until the I-485 has been adjudicated.

  18. Yep. This will evolve to "If you are in the US illegally....." I can't imagine the pressure of those who either enter illegally or overstay their visas. Trump and Homan are turning up the heat.
  19. One option is for US spouse to file as Married Filing Separately....then amend taxes to a joint return after you get a SSN.
  20. If you have a SSN, you can file a joint return and ask to be treated as a resident for tax purposes.

Who would allow an unlimited number of complete strangers to just enter your home unannounced without permission, to set up housekeeping, and to expect you to pay for their food, lodging, health care, clothes, etc.? The homeowner is then in competition with the intruder for use of the kitchen, bathroom, bedroom, etc. It just doesn't make sense to allow illegals to stay, imho. Do they not compete with citizens and legal residents for jobs, groceries, emergency rooms, etc? Looks like the question "when is enough....enough ?" has been answered by the 2024 election. Common sense has returned.
