  1. I watched the video. Jim Hacking, the attorney, is 100% correct, imo!!!! Hacking said to file an I-130 and an I-485. He is right since she entered the US legally, with no intent for fraud.

  11. Some states specifically state that I-797 for adjustment of status is sufficient to satisfy the legal presence requirement. I think the part I highlighted above includes adjustment of status I-797s.

  15. As @Lil bear explained, your I-94 gave you only 90 days legal status.....from the day you entered the US.
  16. I think you are misinterpreting the requirement. You must show that you will be in legal status for the next 12 months....not past 12 months. An EAD will suffice for that requirement.
  17. You are not in lawful status once your I-94 has expired. Submitting a proper I-485 grants you authorized stay until approval or denial, but it not a legal status. Unless your state allows issuing of the DL with an I-797 receipt for adjustment, you'll have to wait for an EAD.
  18. Good luck. Looks like it is exactly 30 days. Personally, I would delay my arrival by a day or two. Otherwise, I'd guess your chances of entry denial is about 50/50. Others might disagree.
