  1. Step-by-Step Guide on Filing an I-130 for a Spouse Inside the US - US Immigration & Visa Guides - VisaJourney
  2. The US citizen is the petitioner. The new immigrant is the beneficiary. The I-130A is completed by the new immigrant (the beneficiary).
  3. I don't think it matters. The CO is not required to look at anything you bring. Good luck. I am moving this thread to the Tourist Visa discussion area.
  4. All your posts are being deleted.  Go away, spammer.

  5. So, this new policy applies only to people who are submitting an N-400 who are nearing the 10 year point as an LPR? If so, it seems to be addressing an issue which is not so common. I don't see this helping many people at all.
  6. We are in Dallas. The estimated time after filing her N-400 (5 year rule) online was 9 months per the web site. In actuality, it took 4 months from filing to interview completed. Interview was done 3 days ago on 12/14/22. I am a solid proponent of filing the N-400 asap.
  7. Yep. I just don't see a light at the end of the processing tunnel. They can promise to bring waiting times down, but I don't see any way under present circumstances...... unless they declare a wholesale amnesty and approve a LOT of pending petitions. The current administration plans to make the English portion of the citizenship interview "easier". They are just focusing on the wrong issues. - Daily rant over
  8. The previous administration tried to increase filing fees which, imo, would have resulted in more hiring. Some federal judge blovked it, if I remember correctly.
  9. Wow! Over 1.8 million I-130s pending...... and over 500,000 N-400s pending...... Outrageous.
  10. Be aware that she will not be able to work or exit the US for as long as 8 months after entering and marrying via a K-1. How can she get a J-1 with immigrant intent? Every couple has their own priorities, and each couple must decide which visa is better for their situation. K-1 More expensive than CR-1 Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork) Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months) Spouse can not work until she/he receives EAD (approx 6-8 months) Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period Spouse will not receive Green Card for many months after Adjustment of Status is filed. A K-1 might be a better choice when 18-21 year old children are immigrating also In some situations, marriage can affect certain Home country benefits, making a K-1 a better choice A denied K-1 is sent back to USCIS to expire CR-1 Less expensive than K-1 No Adjustment of Status(I-485, I-131, I-765) required. Spouse can immediately travel outside the US Spouse is authorized to work immediately upon arrival. Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport. Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.
  11. It sounds positive. But, the case could still be under administrative processing. Patience is the key.
  12. You said the case was denied.... Get your facts straight....before hiring that attorney!!!!!!!!!! I'M OUT!!!!!! Unfollowing this thread.
  13. Part of USCIS is user fee-funded. A former administration tried to raise fees which would have resulted in more hiring. But some judge blocked it.
  14. I guess our case is evidence that filing the N-400 actually really can speed up the I-751 ROC process....😁
  15. Hire a US immigration attorney. Start over and file a new case.
  16. A person cannot enter the US as a visitor with the intent to stay and adjust status. In the video, the plan was not to stay when the young lady entered.
  17. That Tim Sparks guy really, really, really needs to join us here on VJ. He is needs a LOT of education regarding immigration.
