  1. The CBP officer does not determine whether you get a 2-year card or a 10-year card. That will be determined by your records before the actual card is created. If you entered the US after 2 years of marriage, you should receive a 10 year card.
  2. Why would you get an RFE? The ability to support a new immigrant is CURRENT income, not what was earned in past years. Current income is calculated as follows: Gross income from most recent pay period multiplied times the number of pay periods per year = current annual income
  3. Most recent tax year is 2021. That will be the case until April 15th, 2023.
  4. She left before the I-485 was even submitted. I don't see how it can be alive.
  5. Actually, the I-485 was not even properly submitted since she had already left the US before it was sent to USCIS. That is a big, big no-no. There was never a legal basis for the EAD or AP. @OldUser @Mike E
  6. That EAD and AP were based on her Adjustment of Status which was abandoned. Technically, they are now invalid.
  7. Even if she is, somehow, paroled back into the US, her Adjustment of Status was abandoned. It will be denied at the interview or later.

  9. I know the feeling. But you will need marital evidence until the I-751 interview. Our interviewer wanted to see evidence from the date we filed the I-751 until interview date.
  10. We also filed wife's I-751 in March 2019. The status changed to "Ready to be scheduled for an interview" in May 2019. We, then, filed her N-400 in August 2022. We had a combo interview on Dec 14th, 2022. She will take the oath in about 2 weeks from now. You can keep waiting, sue USCIS, or file the N-400. I have heard that suing USCIS is expensive compared to filing the N-400.

  14. Go prepared for a combo interview. With luck, the IO will conduct both. We received an email which stated our interview a combination interview.

  16. You did not read it on THIS web site. No one here will condone visa fraud. You are outside the US, you want to enter via VWP, and you have immigrant intent. Adjustment of Status is not available to you.

  19. That is visa fraud. Don't do it. You cannot enter the US as a visitor with the intent to stay and adjust status. The Terms Of Service for Visa Journey prohibit discussing illegal activities.
  20. There are no benefits in waiting to file for adjustment of status after marriage. Waiting delays working, traveling outside the US, getting the green card, and filing for citizenship. I would borrow the money to file.
