  5. I cannot recall a single case when the USCIS officer even mentioned this subject during an Adjustment of Status interview....and we see hundreds of cases every year here on VJ. The only misrep case during an AOS interview in my memory was when a lady was grilled in secondary inspection, then tried to adjust status. They accused her of a misrep due to specific statements she made during the secondary inspection.

  7. Attorneys give inaccurate information quite often. Show me a case where USCIS denied an Adjustment of Status for presumed immigrant intent. Entering the US as a visitor with the intent to adjust status is fraud. Why would waiting 90 days change the intent a person had when he/she entered the US? The 90 days rule is a Department of State rule. They do not approve adjustments of status.
  8. Why? There is no reason to wait. There is no 60 or 90 day rule for USCIS. Intent is determined at the border when the person enters the US. Can you post a link to an Adjustment of Status case which was denied due to applying prior to 90 days? Many, many, many VJ members have adjusted status after entering as a visitor. I agree that entering the US as a visitor with the intent to stay and adjust status is visa fraud. The OP's post doesn't show intent to AOS before entering.

  10. My point is that the I-751 doesn't make it harder. It adds an unneeded burden on any couple not married for 2 years upon entering the US. It took USCIS 44 months to approve my wife's ROC. I guess, it would have taken a few more years had we not submitted her N-400.
  11. Some scammers will play the "game" until they get their green card. Then, they divorce and move on as is their master plan.
  12. Good question. The low denial numbers certainly (imo) justify the elimination of the I-751 and they prove the consulates are obviously doing a great job of weeding out the fraud before CR-1s are issued. The law needs to change.

  15. I think fraudulent marriages end up in a divorce and immediate I-751 filing with a waiver. They never even reach the 2 year mark. Statistically, only 1% to 3% of I-751s are ultimately denied.
  16. When they changed from 12 to 24 months, many people received an updated extension letter. Maybe, they will issue you a 36 month letter.
  17. So, a 2 year Green Card is now good for 5 years? This is ridiculous! They need to just eliminate the I-751 completely. Only 1%-3% of ROC cases are actually denied.
