  2. Sometimes, an N-400 is what it takes to push an I-751. It is crazy, but that is the case.
  3. Maybe...maybe not. You might be waiting a long time. Good luck.
  4. Take my wife's case for example. We filed her I-751 in March of 2019. In May 2019, the status at the changed to "Case is ready to be scheduled for an interview". The interview, at the local field office, was conducted in Dec 2022 (combo interview after filing an N-400). Service Centers don't schedule and conduct interviews. The local field office does.
  5. Your local field office is the driving factor for I-751s, instead of the service center.
  6. Only you can decide if it was a mistake. However, allow me to inject this: Every couple has their own priorities, and each couple must decide which visa is better for their situation. K-1 More expensive than CR-1 Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork) Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months) Spouse can not work until she/he receives EAD (approx 6-8 months) Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period Spouse will not receive Green Card for many months after Adjustment of Status is filed. A K-1 might be a better choice when 18-21 year old children are immigrating also In some situations, marriage can affect certain Home country benefits, making a K-1 a better choice A denied K-1 is sent back to USCIS to expire CR-1 Less expensive than K-1 No Adjustment of Status(I-485, I-131, I-765) required. Spouse can immediately travel outside the US Spouse is authorized to work immediately upon arrival. Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport. Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.
  7. For DCF, you will need exceptional circumstances. Step # 1 is to contact the consulate and ask them to accept your case.
  8. There will be no need to prove that. The subject never comes up in adjustment of status interviews. Ask the attorney how many cases have been denied due to applying within 90 days...Her answer will likely be none. ... If there was a 90 day rule, we would tell you so. We are telling you that there is NOT a 90 day rule.
  9. Within. Once her I-94 expires, she will be out of status and subject to deportation....married or not. However, once a proper I-485 package is submitted, she will be granted "authorized stay" in the US until the I-485 is either approved or denied. Step 1: Marry ASAP Step 2: Follow this guide below: Step-by-Step Guide on Filing an I-130 for a Spouse Inside the US - US Immigration & Visa Guides - VisaJourney
  10. The fee will be a $220 immigrant fee which is paid online after the interview.
  11. Get an experienced immigration attorney. You cannot adjust status. This will take precise direction and execution, else you might find yourself stranded outside the US.
  12. An I-751 does not require an I-864. Personal Affidavits are NOT required but might be helpful to your case.
  13. Without a proper visa, she won't be allowed to board a flight.
  14. Then, immigration will be difficult for you. Nothing is fast. Have you considered a CR-1? Every couple has their own priorities, and each couple must decide which visa is better for their situation. 15. If you are both living in the same country, why are you considering a K-1? It would be highly unusual for a K-1 to be issued within a year. It will likely take 18 months or longer. Does she currently have a B2 visa?
  16. You cannot legally file as single if you are married. You can file as "Married Filing Separately" or "Head of Household" if you qualify.
