  2. Sorry. You made a gigantic (and maybe irrevocable) mistake. We would have advised you NOT to apply for a B2. Until your situation regarding ties to home country have changed, you are wasting your time. Forget about an attorney. @Mike E has some great ideas.

  4. Almost same issue for us. Status is still "unavailable" after 3 weeks. I spoke to someone at the National Passport Office, but she was no help. I also spoke with someone at the passport agency we used. He said "If they have cashed the check, they have the application. He said they are flooded with passport applications right now." I am also planning to contact US Senator soon. As of right now, wife has no US passport, and her original Naturalization Certificate was in the passport pack, too. Passport website says expedited is now 5-7 weeks.

  6. I don't think you are considering a K-1 or a spousal visa. I think you are considering something else.
  7. The I-130 would, likely, be approved relatively quickly. The delay would come between Service Center approval and NVC actions.
  8. There have been cases here where a person was issued the F2B visa while single, then married before entering the US via the visa. It caused very, very serious consequences.
  9. 1. You cannot legally enter the US as a married son/daughter of a Green Card holder via an F2B visa. Doing so could be seen as fraud causing a host of legal problems for you, and it could prevent you from becoming a US citizen and/or petitioning your spouse. 2. Your children can be included in the petition as long as you are unmarried.

  11. There is no form. We simply uploaded a simple, business style letter explaining that we had waited a very long time, and we requested a combo interview. Did it make a difference? I'm not sure. However, we had a combo interview. Good luck.
  12. Thanks. I don't think I have seen that before. I'm guessing the consulate made a mistake. Normally, the Immigrant Visa section of the consulate handles Fiance visas, not the Non-Immigrant section. That might explain why there were 2 interviews. Immigrant visas and Fiance visas are normally "Issued".
  13. This case is "different" from usual cases. Multiple interviews are not normally conducted, and I don't recall ever seeing a status change to "Approved".

  15. I have seen a total of 2 cases which were supposedly "appealed". I have seen many, many cases expire at USCIS. Once a case has actually left the consulate, game over.
  16. That is an extremely rare outlier.....not the norm. We have seen many cases as I described. Unlike a spousal visa petitioner, a K-1 applicant is almost never allowed an appeal.
  17. The pay stub(s) you submit to show current income will have a company name on it, yes? You are overthinking this.
  18. The evidence you use to prove CURRENT annual income will provide the answer. Current annual income is calculated as follows: Gross income from most recent pay stub multiplied times the number of pay periods per year= Current annual income.
  19. He cannot legally file as single. He can file Married- Filing Separately or he can file as Head Of Household if he qualifies. This is an IRS issue, not an immigration issue.
  20. Normally, that is not true for a K-1. Consulates have sole approval authority. Usually, they merely return the K-1 case to USCIS where it expires. An expiration notice from USCIS is all that the petitioner gets.
