  2. After all these years, it's good to see that your marriage is still strong. This has been such a long and trying process for you both. I hope the new attorney will succeed in helping you. Applying for the DV will not harm your I-130 case. Good Luck.
  3. Yes. 48 month letters are being sent to people currently waiting for I-751 processing.
  4. That is a viable option. Many people have done that.
  5. ****Thread moved from General Immigration to Waivers forum**** Everyone here is free to reply to threads., just as everyone is free to ignore any advice given.
  6. My advice is to scan and upload. Following their instructions is usually always a good choice. YMMV.
  7. Follow their instructions as written. I would scan and upload the full page. I would scan the physical photos and upload them.
  8. I've said this before, and I'll say it again. Only around 1% of I-751s are eventually denied. That statistic should be sufficient justification to eliminate I-751s altogether. Just give all spousal visa holders and those who adjust status a 10 year Green Card at eliminate all this inefficiency and agony.
  9. I think it was a mistake by the consulate. I think they were initially interviewed for the wrong visa type. Just my speculation.
  10. If you have sent your 2022 tax return to the IRS, there is no need to wait. Just submit a copy of what you filed.
  11. Visa fraud is not condoned on Visa Journey. Seems you are visa shopping. You already knew the legal K-1 process is long.
  12. CURRENT income is king....not what was reported to the IRS unless you are self-employed. Current income is determined by most recent pay stub for employees, not tax returns..
  13. You can submit EITHER a copy of your transcript or a complete copy of your tax return package. It's your choice. Personally, I would send whichever is available now. Form I-864, Affidavit of Support Under Section 213A of the INA (uscis.gov) "Item Numbers 23.a. - 25. Federal Income Tax Return Information. You must provide either an Internal Revenue Service (IRS) transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years. You are not required to have the IRS certify the transcript or photocopy unless specifically instructed to do so by a Government official; a plain transcript or photocopy is acceptable.
  14. What You Need to Know About Temporary Protected Status for Ukrainian Nationals (legalaidnyc.org) What documents will I need for my TPS application? In order to apply for TPS, you will need to prove three things: (1) that you are a national of Ukraine, (2) that you were residing in the U.S. on April 11, 2022, and (3) that you have been residing in the U.S. continuously since then.
  15. I don't think so. Had you married after 90 days, then failed to include an I-130, then THAT would have been a problem......but you just sent an extra form.
  16. Yep. The 48 month extension letter would be of little value in your case. It would expire this year. I can't think of anything else which would come from NBC. We were in the same situation until my wife filed her N-400. Her I-751 had been "Case is Ready to be scheduled for an interview" since May 2019.
