  1. That just isn't true. "Married filing separately" is available. As a tax issue, you cannot legally file as single if you are married. There is no immigration issue at NVC. You might want to amend your tax return once your spouse has a SSN.
  2. I haven't seen a single comment which said that.
  3. This sounds strangely familiar to what Kamala's staff said....
  4. What are the chances the OP would inform the GF of his plans so that she would bring the necessary items for staying and adjusting? I'd say about 100%. This has come up before.
  5. I disagree. Immigration takes two people. As spouse and sponsor, the OP would be part of the adjustment process. Thus, OP's pre-planning for future spouse to adjust status from ESTA is prior intent, imho. I believe OP would likely inform fiance to bring needed documentation and other items to stay and adjust (which could be cause for entry denial). Just my opinion.
  6. Most people who travel that far, for a visit, can't just suddenly decide to stay in the US. It just isn't practical. That would require pre-planning.....which is visa fraud.
  7. Yes. It is required. All petitioners must have domicile in the US or evidence to prove intent to re-locate back to the US. Green Cards are for living in the US.
  8. Notice the words "May not" and "if". It doesn't say you don't qualify.
  9. Personally, I would take the chance, Each consulate has its own policy for re-scheduling. Personally, I would attend the scheduled interview, if possible. You have the option of entering the US to "activate" the visa, then returning to your country to tie up loose ends. Just an idea.
  10. I haven't used travel insurance, but I can tell you that there are no perfect insurance plans for travelers. There will always be high deductibles, exclusions, claim issues. You probably just have to find one you can tolerate. Good luck.
  11. No. They are all separate, independent cases. There are no derivatives.
  12. Sorry. That doesn't make sense. How does she feel about it?
  13. You are playing word games. It is illegal to enter the UD as a non-immigrant with the intent to adjust status later. You are planning this. It is fraud. We are prohibited by the terms of service, to condone this.
  14. Rationale for my comment above: My wife's removal of conditions took 44 months for approval.....with NO RFEs!!!!
  15. I very, very, very strongly advise him to delay entry until AFTER the 9th of August...by a couple days. You do NOT want to go through removal of conditions. He can mention it to the CBP officer, but the officer doesn't make the determination between 2 or 10 year card. If he enters after 2 years of marriage, USCIS will, excluding a mistake, issue a 10 year Green Card regardless of how the CBP officer stamps the passport.
  16. By whom were you told that? I have seen numerous people succeed by contacting their Senator. Good luck.
  17. "Can he apply for his first passport abroad? " As a US citizen, he must exit and enter the US with a valid US passport. Call your Senator's office and request help. They can find you an emergency appointment.
  18. When did you file the I-751? 2021?
  19. Yes, If your visa has the endorsement stamp, you are good to go.
