    They put a rejection stamp in the passport? Must be a different procedure from US consulates. Anyway, I don't think it would have any effect.

    Certainly sounds, to me, like an F-1 for the student. Not sure where the OP got that other information. I know of no situation or visa which fits what was posted.

    This is how the DQ process works: The interview is scheduled by NVC. I hope you get the interview letter soon. 1. Case is DQ'd by NVC. 2. Case then enters NVC queue for your consulate and waits at NVC. 3. Consulate informs NVC of available interview date for upcoming month. 4. NVC schedules interviews for cases at the front of the line. 5. NVC schedules your interview when your case reaches the front of the queue for that consulate. 6. NVC notifies person of interview date via email. 7. NVC then sends case to consulate. After the interview is scheduled, it can take several days to several weeks for the consulate to receive the case.

    Contact NVC and tell them to hold off scheduling your interview until son's case has been DQ'ed. Ask them to schedule the cases together.

    But by doing so (filing based on a divorce waiver), it rightfully informs USCIS of the pending divorce, and prevents a premature decision based on a joint bona fide marriage when the I-751 approval should be based on a divorce waiver. ....just my thoughts. I think the RFE would give you 90 days to produce the divorce decree.

    We have a great CPA who well-versed in tax matters involving foreign income and accounts. She has done our taxes since 2017. She does the tax returns, foreign asset reporting, and FBAR. I can PM you her name if you wish.
