Where are you right now? If you are currently inside the US, you can concurrently file an I-130 and an I-485 (as long as you didn't misrepresent yourself at POE). Be aware that you cannot work in any way or leave the US for up to 6 months or more until you have proper authorization. If you are currently outside the US, your US spouse can begin the spousal visa process by filing an I-130.

You parents' cases are separate entities. There is no connection between the two. If different USCIS service centers are involved, it makes any comparison even more invalid. On average an I-130 takes about 14 months for approval according to Visa Journey statistics. It looks like you are not far from that average. I would expect approval soon if there were no other issues. Hopefully, you will receive good news soon.

"Danger" is having a Vice President who, along with the media, deceived the American people to our faces about the mental condition of the sitting President. During Biden/Harris, we have run-away inflation, an invasion at out border, a promise to RAISE taxes, and more world turmoil. Which of these policies offends you: Lower taxes? A secure border? Our immigration officer was very interested in seeing our drivers licenses showing same address, bank statements, and a solid paper trail of where we lived from I-751 to interview date. He wanted to see signed copies of the leases at every address.

My wife and I had a combo interview. There will be 2 interviews....first the I-751 interview, then the N-400 interview. What info did you submit with the I-751? During our interview, the immigration officer wanted to see clear evidence that we were still in a bona fide marriage from the time of submitting the I-751 until day of interview. Take updated evidence showing you both live together at the same place, sharing finances, and evidence normally created in a real marriage. I would several bank statements for each year. BOTH OF YOU MUST ATTEND!!!!

I think the OP is asking if he/she really did accrue illegal presence. The OP said "At this point I am trying to go to the U.S and complete my degree." Even without a bar, IP might have a tough time getting another F-1. So, I think the question of unlawful presence is valid.

How so? When a person accrues more than 180 days of unlawful presence, they are barred for 3 years once they leave the US.

No harm to write the letter. We included a request letter along with the N-400 application.
