    This is from I-765 instruction:

    "If you are a lawful permanent resident, a conditional resident, or a nonimmigrant authorized to be employed with a specific employer under 8 CFR 274a.12(b), do not use this form." 

    We applied for the renewal of EAD and the Remove Conditions but both were returned for the wrong fee amount. I am not sure if that is because we included the biometrics fee, the instructions are so confusing, but you are saying I don't have to renew the EAD?

  2. Filing for the EAD before AOS is a pointless waste of $380. It will expire when the I-94 does and takes almost as long as the I-94 is valid to receive after filing.

    The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.

    You need all the supporting documents for each form as well, so read the instructions for each one. You can also search here on VJ for what to include with each form if you get stumped. There are also example forms here on VJ you can look at when filling out the forms. They can be helpful.

    So we got married on 5/17 and we are preparing the AOS, etc. Which eligibility category do we choose, (a)(6)?

    Also on the advanced parole request it asks for specific dates and reasons for travel, do you have to fill this out? I thought it was only for if an emergency and travel is required. If no travel is planned do we need to submit this form?

  4. My fiance just arrived in the country. Will I save money, the $385 fee, if I wait until after we are married? I am not sure because of this statement from the instructions:

    "If you filed Form I-485, Application to Register Permanent Residence or Adjust Status, as of July 30, 2007, and you paid the Form I-485 filing fee, no fee is required to also file a request for employment authorization on Form I-765."

    does as of July 30, 2007, mean if I am filing after this date or before? So if I file the Form I-485 and Form I-765 concurrently will I only have to pay the $985 fee or will I still have to pay both? Trying to decide, because he wants to start work ASAP.

    This process is so confusing and expensive, filing fees for paperwork seem outrageous and never-ending :(
