    I'm sorry for the trouble you are going through.
     
    That said, their decision was correct given the data available to them. If he's not your biological son, you shouldn't be listed as such on the birth certificate (at least from a legal perspective). A birth certificate is intended to show (presumptive) biological relationships, not just legal paternity. As far as immigration is concerned, he may qualify for US citizenship and therefore is ineligible for a visa. If he is your biological son, then he needs to be recognized as a USC first. As-is, a non-immigrant visa is not appropriate.
     
    Getting a DNA test to prove/disprove paternity would be suggested. There's also the possible options of adoption of the child or, if you want, marrying your partner.

    simply put the i130 only creates a visa number for you to be eligible for a green card. the i485 is what gives you the green card. so only submitting the i130 without the other will not prevent a deportation. they messed up not ice.

    That's correct.
    You are not allowed to work without the EAD.

    The authorization to work IS the EAD.

    You can have a SSN WITHOUT the ability to work. You have to be able to prove you can work when you have a SSN, either by simply being a USC, or having a form of proof you can work such as a green card or EAD.


    She will need to wait until she gets the EAD. EAD stands for Employment Authorization Document. The EAD -IS- the document required for the part where the SSN says "Work with DHS authorization". 

    That doesn't mean she was authorized to work, it means she can work with DHS authorization, and again, EAD -IS- the DHS authorization.


    Note, that if she has a job offer, you can contact USCIS and try to get an expedited EAD, but it still may take a little while to get it.

    Sadly, this is often a cost associated with immigrating to the US and re-starting your career. Foreign university credits often do not transfer to the US. Others in this forum have done some research and found organizations that assist people in translating and/or transferring foreign academic and certification credentials to the US. You can search this sub-forum for info about such organizations.

    This is quickly becoming something that's none of my business, but what is your fiance's ex girlfriend doing with his phone, or in a position to have access to it? It sounds like something beyond your knowledge is going on here. Either he's way too close with his ex, or he's not being honest with you and cancelled it himself.

    Well, that will be visa fraud. So think twice before trying to adjust her status while she's on a B2. Not that no one has ever done it before but if this adjustment of status application is denied, it will be difficult for her to get another tourist visa in the future. Reason being, the future consular officers and CBP officers will know that she has an immigration intent.

    Best advise!!!  There is absolutely no reason to rush this.  If this is true love, slow down and smell the roses.  There is no need to marry immediately.  Go stay with him for an extended vacation.  Meet his family.  Embrace his culture.  When we take our rose colored glasses off at the end of the day, life and marriage takes work.  Give yourself the deserved time to test the waters of this relationship.  Five months is not a lot of time to be true to yourself in this sense.  This is the high, euphoric stage of any relationship, regardless of age. 
     
    Please, take a step back.  Listen to the advise given here.  We have seen over and over situations like yours that have had disastrous endings.  Your case may be completely different.  This may truly be the love of your life, however, you do not have to rush it at this point.  Count the cost before making any permanent decisions.  We here are like family and we do not want to see you hurt.  We all know what it is like to be in love and know that love at times clouds our judgement.  
     
    Wishing you all the best in your decision.  Ultimately, it is up to you what you determine is the best course.  I believe that you have a little doubt in the back of your mind because you reached out to your Visa Journey family.  Go with your gut!!  We as women, no offense to the men, were given instincts that we must listen to.  Take care of your heart sweetie!  It's a precious thing.

    Perhaps the OP should move to Nigeria with him for a year or 2. If he really loves her he will agree. I doubt he will care where they live as long as they are together, right?

    most similar cases here ended very bad for the USC. We had women here who have been put in really bad situations after the foreigner got his GC and they only found out later that love is blind. They were made to believe that they press for the "process". Everyone could manipulate a partner to believe so. A 22 year old little boy, with a 62 year old women, just is not common. In fact, in places without immigration benefit, such relationships to end in marriage is 1 in a million. However, when immigration is involved from a 3. world country, such cases are VERY VERY COMMON. Thus, there is something else in play rather than love. Again - love makes blind. Take care of yourself and don't be tricked into believing something easily.  As for USCIS, of course you can file and try your luck, but they are well aware of such cases. In fact, all over the world, older well situated man mingle up with younger women and marry. This type of age difference and marriage is seen also without immigration benefit. However, a 22 year old boy to marry a 62 year old women, happens close to never anywhere in the world.

    Well, in 99.9% of such cases, the USC or Green Card holder is duped by the young man. We are discussing cases from all over the world here, why always Nigeria pops up for such kind of relationships? Other members of VJ mentioned, that they got offers of 50+ young Nigerian man to help them find an older women for visa purposes. 
     
    So, this story is very common here, and hardly every ends well for the USC. Love makes blind. So my advice is, to
     
    a) take care of yourself, there is a slim chance that the young man is feeling the way he says
    b) there is very little chance that he would get a GC, as USCIS knows such cases, in fact, they may deal with 1000s of such cases just from Nigeria and Marocco alone every year. This is as suspicious as it can get. Why such storries almost never pop up from ESTA/Visa Waiver Countries but always involve younger man from 3. world countries? If this was a common relationship type, it would happend all over the world and not only selective in those high fraud countries.

    The media really irks me about these refusals. First, the anti-Trumpers get on the bandwagon without really processing why the people were denied entrance or scheduled for deportation. Then a couple of days later, just casually the press says..oh they have been illegal for like 10 years, over stayers and involved in drugs...smh...
     
    This then scares legitimate travellers like yourself.!!

    This would be a very very bad move before you have completed your adjustment of status. Part of the AoS requires that he earn a particular amount (and have a history of it). By doing this, he would possibly be considered unemployed (or not employed enough) and it could  result in your green card being denied.

    Co mingling is more important at the ROC stage. They don't expect too much with newly weds.

    You have to wait until he has his ead card before you can proceed with ssn, etc... When we sent our aos package, we sent photos of the wedding, marriage certificate and messages from facebook from friends as proof of relationship. We didn't get an rfe. We are now waiting for our interview-where we will bring more evidence of relationship (joint accounts, shared bills).

    What you are talking about is quite frankly visa fraud. It is unlawful to come here on one visa knowing and planning to get married and file AOS. If you want to go that route file for K1 visa for him.

    I'm very surprised they let you on an international flight without a passport. How will you get back into the U.S.? Don't you have to show a green card and a passport?

    To me, it's not a good idea to go abroad without a passport. You're asking for trouble.

    Yup we didn't have any of those. And we didn't use a co-sponsor for the k1 visa because they don't allow it in the Philippines. I only had his pay stubs, form134, letter from work and bank joint account certificate.
     
    Again, our process in my country's us embassy might be different from yours.
     
    And he just received his first w2 and filed for taxes last month.
