    Lol, if you know anything about Kenya, then you know something about Uganda, and that means you should understand how the agents at the door won't allow you to even enter the airport if you don't have the documents they "think" you should have. So that's how he was barred entry from Entebbe. He presented a ticket to the US. They asked to see his documents. When they saw the expired GC, they didn't even allow him to show his extension letter. My husband attempted a 2nd time. That time, the doorman allowed him in, but the extension letter had expired, so at the check in counter they told him he couldn't board. Being that this was an actual airline agent, we took that to be official word. I had literally just birthed our 2nd child and was in no position to be researching things. So that's how that went down.
     
    During the height of COVID, Uganda was in the middle of the world's longest lockdown, and I can assure you, unless you were a diplomat, you weren't getting a flight out of Uganda.
     
    I haven't seen this other poster. Do you know their user name or post title? I'd very much like to read it.
     
    So are you saying that if we get him to Canada, he can definitely enter and not be detained on the spot? We are doing all we can to avoid any detainment.

    Hello everyone. 1st off, I'm very grateful for the support and sharing of knowledge in this community.
     
    I won't get into details, but if you want them, you can look through my old posts.
     
    My husband applied for AOS in 2019, and we took a trip back to his country to spend Xmass with his family. COVID broke out, blah blah blah, he ended up staying out for too long. We were going to apply for the DS117 visa, but before I got to it, I got an AOS Denial letter.
     
    All that being said, can we apply for IR-1 Visa now? Are there any extra steps we need to take, like him turning in his expired GC? 
     
    What do the chances of an approval for an IR1 after AOS denial look like?

    For clarification, until an immigration judge issues an order of removal following a denial which formally terminates the status, he remains a LPR.
    Put his A# into this link HERE and see what comes back. 
    If there is a termination notice on file, then an IR-1 is the way to go. 
    If nothing found, then the denial was issued but they remain a LPR as no following action of NTA, court case and ruling in abstentia has occurred.  However, unfortunately, despite remaining a LPR in this situation, airlines do not allow people to board with an expired 2 year card and an invalid extension letter. And you can't obtain an i-551 stamp outside of the US either, even though he is entitled to one. So, you find yourself in limbo and a catch 22. 
     
    So either 
    1) try a land border - canada or mexico - with the expired card and prior receipt - will be a fair bit of hassle, but should eventually be let - possibly paroled - in once they run the A# and see a denial with no refile and pending case, as all LPRs are entitled to a hearing with an immigration judge and due process. 
    or
    2) File and pay for a fresh I-751 from within the US with a US mailing address. Get receipt and extension letter. Send that to him. As the letter is useless with a card that expired three years ago he then needs to go to the embassy for a I-131A boarding foil ($575) and go through that process to get a document to permit boarding a flight back into the US. Covid stuff is a reasonable excuse for extended periods out of the country beyond what would normally be permitted
    or
    3) an SB-1 if applicable. Again, covid stuff is a reasonable excuse for extended periods out of the country beyond what would normally be permitted, but there are limits to how far you can push this reason. 
    or
    4) file an IR-1 and start from scratch.  Following a recent clarification and some case law - see HERE - you can adjust status now after a denial but without having to wait for an immigration judges ruling and formal termination of status, so it follows that that should also mean it should be applicable to an IR-1 instead of an i-130 & i-485 adjustment in country, but it will require a fairly competent lawyer to do so.
    I am not your lawyer so please seek your own qualified legal opinion as to whether this is applicable in your circumstances before taking any action.
     
    Broadly, those are your options.

    Hi you guys! 

    Thank you all for answering me. Guess WHAT? 

    My husband and our Furr baby made it through the airport with no problems whatsoever!

    Since this post is particularly about bringing our cat, I will only talk about that process.

    We got her rabies vaccine a month before we traveled and made sure that the vet put the vaccine sticker on the card. Everyone was telling us that Uganda requires an export permit to allow an animal to pass, but it proved almost impossible to get. We figured it was just a way to rip us off, because I had talked with other people who have taken their pets out, and they never were asked for such papers. So, we decided to go with only the rabies certificate. 

    Entebbe airport was a breeze. No one inspected her or any papers at all. 

    We flew from Entebbe to Instanbul to Houston on Turkish airways, and the total pet fee was only $210. 

    On the flight to Instanbul, little Neffie managed to pull the zipper open, and got out! Fortunately, the flight attendant who caught her got a real kick out of it! He just laughed and said, "Please don't take her out again." 

    Instanbul customs never asked to see any paperwork, but they did thoroughly check her bag, so I had to hold her while this went on. We were able to keep her out of her bag on her harness and leash the entire layover in Instanbul and no one said a word about it. 

    The flight from Instanbul to Houston was 13 hours! Neffie did an exceptionally great job, and only got antsy one time. 

    Getting to Houston, no one even noticed that I had a cat until I had already passed through immigration! I told the officer who heard her meow and who was the same guy that scanned me in that I declared her on my form, and he was like, "Oh yeah, I did see that. Oh well. Is she okay?" YEP was all I said. So no one even inspected her to come in to the USA. 

    I think we were seriously blessed, because I never expected it to be this easy. 

    I would still recommend that everyone get their cat vaccinated and have a health certificate, just in case they are asked for them. But know that bringing your kitty is  not as scary as some would have you think.

    P.S. Turkish Airlines is the only airline that flies from Africa to the USA which does not require a micro-chip and pet passport!

    We got our NOA1 on October 13th. My husband is from Uganda. Up to now, we haven't heard anything. I just hope they are at least doing SOMETHING with it! 
     
    It's very frustrating to see so many people with European spouses get their NOA2 quickly compared to those of us in love with someone born on different continents. 
     
    The West will always vouch for The West, it seems. 
     
    Good luck to all of us who have a non-European spouse! May we be blessed with an increase in workers at Nebraska and a few miracles to make our NOA2's arrive in a timely and fair manner.

    To all of you who are from "high fraud" countries, we want to encourage you! We made it through the Nairobi, Kenya embassy during the Kenyan elections mayhem, and we had a lot of worrisome things in our paper-work, but we made it through! 

    My best advice, BE PREPARED and have every single document you can imagine they might possibly ask for, even if it isn't "required" during the interview. The CO asked my husband really rude and abrasive questions, implied things about both of us, and twice told him that she couldn't approve him because he didn't have X document. Fortunately, I prepared our binder in a beautifully organized rainbow of tabs, and he was able to find both within seconds. He said she was shocked both times and it took her a pause to recollect herself. 

    So be READY for the worst, but fireproof yourselves. They will treat you like a cockroach, but don't let it get to you. My sweetie said that had we not discussed all the possible questions and situations that could unfold, he wouldn't have been able to get through it. He would have accepted defeat. So being mentally prepared and armored is so important. 

    We wish the best of luck and love to each one of you. I am so sad and disappointed that some of you went to Nebraska around the same time as us. I do know how you are feeling because we were feeling it, too. We were one of the last October filers to be approved (of those who have been approved), according to the apps and this forum. It is grueling to wait. I wish we had good advice on how to help in that part, but we don't. Just know that our hearts are with you all. Stay strong.

    WE WERE APPROVED!!!!!!!! All glory to the Most High Jah!
     
    It was not easy at all, and see think the woman we call the tiger (she is very well known in Nairobi for denying people) had every intention of denying my husband. However, because of this amazing community, we had the largest file in the building and everything she asked for, my husband pulled right out. 
     
    We learned that EVERY document is as equally important. Please make sure that you have a copy of all the official forms you have filled out. They asked to see all of our NVC paperwork, and skimmed over our I-864A and Tax Returns with a fine toothed comb.
     
    She was very cold, and asked questions that were meant to confuse, but my Gooby got through them all.
     
    Be prepared. Know each other's past in detail! And good luck to you all!!!
     
    We are so overjoyed to be finished with this madness!
