    I just have a simple question to ask.

    My spouse made $19,000~ last year, and she has quit her job to pursue better ventures as I can afford our family through my job back in France.

    I am working from the US - I own a company, have employees, and manage them from here. I have a job agreement (with my own company) that shows me as making $5,000/month - dated 01/01/2015 to 01/01/2018. My bank statements average $7000-8000/month in income (bonuses)

    I have supplied US and French bank statements showing that I have the aforementioned income. I have also supplied my French job contract. We still included her W-2 and last tax return of $19,000, but again, she is starting up a business right now and is not making any money except for online freelancing. We listed her expected income for this year as $12,000 (she makes around $1,000 freelancing online). Due to change soon.

    We live in the same house. As far as I understand from the instructional forms, an intending immigrant who is the spouse of the petitioner, and/or lives in the same space, can list his/her own income and be listed as a co-sponsor. This is what I understand from the instructions for form i-864.

    Am I right with this? I'd appreciate ANY feedback - you guys are an amazing community!

    Apparently, I do not need to complete i-864a as I do not have any accompanying dependents.

  2. Thanks a lot for the information! I've been digging around my documents, and I have these to prove my occupation:

    - A 3 year contract between me and my employer (which started in December 2014) with a monthly salary of $5,000 USD. Contract ends December 2017. In French, I will translate this myself

    - French bank documents showing that I have been receiving approx. $60,000/year in my bank account (sender not shown because they transfer it physically at a branch using cash)

    - Proof of payment by my employer that they have been paying my social security taxes since December 2014 (approx 300 EUR/month)

    - Bank of America statements that show around $70,000 in wire transfers to my account from France between Dec 2014 - Dec 2015

    We don't file taxes the way you guys do in France. $5,000 is my salary after taxes - my employer pays my taxes separately on a different system. Therefore, I do not have tax returns.

    Do you think these would suffice?

    I'm not sure if anyone remembers my last thread - but my mother turned out to be fine, and I ended up being able to stay in the US until at least I get my AP.

    I'm getting ready to file everything ASAP (i-130 and i-485) - and my wife just filed her taxes! Here are some questions I'm stuck on though...

    1) My spouse made $18,945 in gross income last year, which is $1,000 or so below the 125% of the poverty guidelines. We have gathered around $5,000 in cash, and got a letter from a bank account stating that we have that amount to compensate for that $1,000 gap.

    2) HOWEVER, my spouse just quit her job, and is doing some basic freelance work/is a partner on Youtube. She expects to make around $20,000 this year, also, but through online freelancing... I have a company in France that I manage from the US, and I'm making around $60,000 per year. I know that, since my spouse and I live together, I can include my income using i-864b... But is this necessary since we have her $18945 tax return and the cash in the bank? If it is, through what documents can I prove my income in France? We don't really have anyone to be a co-sponsor in the U.S...

  4. Hey everyone,

    I've been lurking on this forum for a long time, and I'm really sorry that my first post will be one asking a question. Thanks for the AMAZING content! I hope to be a lasting member helping others as I learn more about the immigration process. :)

    So - I have a problem. My mother just had a stroke back in Paris... and I really, REALLY have to go back next week (25th of Dec or so).

    The thing is, I got married to my spouse coming from an F-1 status on the 17th of November, 2015, and we have not filed i-130 or i-485 yet. We were waiting for Jan 15, when my spouse receives her tax return from her employer, so we could get the i-864 straight and file i-130 and i-485 concurrently.

    This completely messed everything up, and it isn't a question for me to go back or not. I absolutely have to go back - but we have a life here together that we've been building. (we just had our 1st month anniversary!)

    Obviously I don't work in the US, but I have income through an online business based in France, if anyone's curious about my work situation.

    On to the main question...

    Would it work if we filed i-130 today, I left the country on Dec 27, my spouse receives the i-130 transfer notice and files a i-129f, and I get a K-3 visa in Paris, and hopefully come back to the U.S.?

    This is what USCIS recommended I do on their toll-free line - but I've seen across recent threads that "K-3 is virtually extinct", so I don't know if this is the way to go. I also don't know how long the K-1 would take - if it's 3-4 months, I'd rather go with consular processing for the green card...

    My problem is that I want to come back to the U.S as soon as possible. I don't care if it takes more time to get my green card here - I love my wife and want to be with her - I don't want to stay away from her for another 4-6 months!
