  1. Hello everyone,

    First my question is there anything I have missed? My fiancé is scheduled to have the interview in Guangzhou later this month. We have completed the ds160 online and made appointment to the dr office. We have the I-134 with all documents as well as her divorce, birth and criminal history. paid the fee for her and her daughter. I though that the consulate would ask her to send the documents in but I guess she just needs to bring everything to the interview? Is this correct? We downloaded the K1 instructions from ustraveldocs.com and I did not see where we had to do anything else. Any advice would be helpful. I just feel that it would be better system if they review the paperwork before the interview. But who am I to question.

    ps my timeline does not show all of the packet dates as I am not sure what those are. I did not want to put a false sense of a timeline on here.

  2. My fiancee did hers quite well because I sent her all the information that was needed to make the nice picture. However you state that your picture is not up to par with the requirements. It may the possible to upload a digital picture of her and print the picture yourself but I am Not sure as I did not do this. Otherwise I think you might need to get the proper picture. I guess the most risky option is to submit it the way it is. But you run the risk to get an RFE. So if you did decide to try this I would certainly and immediately have her get the proper picture and send it to you that way if you do get the RFE at least you will have the proper picture in your hands quicker and can send it to them.

  3. Okay so I do all the work to get everything ready to file i-129 F petition. Now I have received the g-325a biographic paperwork from my fiance and her daughter. Originally I had filled all the blank spaces with the word "none" but I notice that now the USCIS says to just leave it blank. So I went back and deleted every space that was not applicable or was listed as none. My fiance printed off the paper and signed it and sent it to me.

    But I accidentally left one field that had the word "none" it was the field at the bottom where it asks for their first name and middle name and last name. Chinese names do not have a middle name. But unfortunately on the g-325a paperwork it says "none" for the middle name.

    So should I leave this as is or use some white out? Or possibly could use an eraser to get the ink off the paper. It is ink from the printer not anything handwritten? It would be a big hassle to have this paperwork redone and shipped to USA.

    Any suggestions would be greatly appreciated.

    Suggest that your fiancee get a notarized letter (in Notarial Certificate format (AKA White Book)**) from the father authorizing the child to immigrate to the US. Highly doubtful that the US government will want to get involved in an international child custody battle, they would likely just deny the visa; easier to just get the letter.

    I have seen my Chinese wife's divorce certificate, she had sole custody. When we were starting the process, I suggested that she get a notarized authorization letter. She obtained a White Book stating the same, submitted it to the Guangzhou consulate, had no issues.

    It sounds like she will need to have prepared White Books for her divorce decree, her and her daughter's birth certs, and daughter's immigration authorization letter.

    Today I called the USCIS and explained that my fiancé would have her white book (divorce paper) included in the I-129f and it would show that she has custody. I asked them if this was sufficient proof of " elligiable to immigrate" I was told that this would be OK but I am with you guys. The last thing anyone wants are issues to surface. So I will ask her to get this kind of paper notarized by her ex husband. Her Ex husband works out of their country and just comes back to visit his daughter once and awhile. So this may take time to get. I am just worried because I do not know his thoughts or reaction to this. Espeicially since my fiancé wants to avoid it if possible. But special thanks to you guys because we have time to get this before any interview in Guangzhou.

    I have found that USCIS really only gives you basic information and refers you to the set instructions. They are clear enough but would really help if they were a little more specific about things.

  5. Welcome to the forum. In the beginning of your visa journey, the visa petition process is all about the required info from the petitioner. In the visa application phase, at the the interviewing visa phase of the process, the beneficiaries will have to provide required info. Here are some useful links that may be of use to you:

    BTW, when your fiancee gets her and her daughter's legal documents, likely Notarial Certificates, it is wise to get several copies of documents at that time. It will likely be far easier to get those documents while in China now, than later on when they have moved to the US.     Thank you for your advice! That is a relief that I do not need the birth Certificates right now. Because it will take some time to get these. I am wanting to file the I129f as soon as she gets the G-325A signed and returned to me.

    Another question. She has custody of her daughter, and it states this in her divorce papers. But will she have to get anything signed by her ex-husband to "allow" his daughter to come here to live? She really does not want to discuss this with him unless she has to. So it would be much easier on her if she does not need anything signed from him. I would assume that she would need this (if at all) when she goes for her interview at the consulate.

  6. Hello everyone I am planning to submit my i-129f and G325A paperwork very soon and one of the questions it asked on which embassy that we would be using. We have two options based on location and they are Beijing and Shenyang. My question is quite simple and if one is better than the other as far as being convenient, or having less problems. It really makes no difference to us which one we go to but it will definitely be one of these two. I would really appreciate any suggestions along with the reasons of why one is better than the other.
