  1. I would stick with the AOS!! TPS is only temporary and who knows what president will get rid of it one day. Also TPS does NOT lead her to become a greencard holder. Whoever is telling you to apply for TPS does NOT know what they are talking about! Like the previous poster suggested if you did not file date I-131 or I-765 with the AOS I highly suggest you do. It's free and she will be able to travel/work before the greencard is approved. Even if you don't *plan* on her working or traveling it is good to have *just* in case. Good luck and I hope your family is safe in Haiti!

I was in Port au Prince visiting my wife and son when the earthquake happened. We felt the building shake and ran outside. Thankfully everyone is okay and there was no damage, but it was a scary experience.

I’m glad you are all safe! My in laws live in Port au Prince so they were safe too this time luckily. I hope your wife and son will be able to arrive soon!!

    Good Morning,

I have my family safe and they have been living on this older ladies lawn since my house was destroyed in the earthquake my husband had to pull my mother in law and daughters out the rubble but their all ok thank god. we are thinking how to make a way down the line. prayers up for Haiti my husband has been helping find people with no good outcomes and the babies so many loss lives I wish they were prepared but this is haiti so many houses business schools are lost.

I’m so sorry- I am glad your family is okay- that is so scary. My husbands cousin/aunts/uncles all lost their home too. They are in the Les Cayes area but very remote. We are raising money to send a construction team from PaP to the Les Cayes area to fix/rebuild some homes. They haven’t had any organization arrive and it’s been almost two weeks!! They are organizing themselves though and looking out for each other. I hope you husband and  daughters can come here quickly! I’ll pray for your family

    Thank you @Luckycuds.

I just got back from the PO and after explaining the situation to them a couple times (they were completely stunned and confused as to what was going on haha)
I managed to get some form I was told to fill in, as I drove home the postman just happened to be delivery some letters to my house and I explained the situation to him and he wrote down my information, told me he would get in touch with the PO and a couple minutes later he called and confirmed I will receive any mail that has been expected to go to me.
And wouldn't you know it, I just now received my AOS, EAD & AP NOA1's haha, oh thank gosh, finally some good news, thank you again luckycuds :)

This thread can now be closed.

    AWESOME timing!!

Unfortunately I haven't had any luck in getting through to someone to actually explain my situation, let alone tell them my previous address was in Australia, I'm about to head into my local post office and see if I can sort it out there but was hoping to do it online.

And that is actually a brilliant idea, I will do that as well and see if that helps, thank you very much :)

That stinks- it’s always so hard to get through on the phone for any place!! I can only imagine your frustration. Good idea to go down to the post office to speak with someone. Bring your marriage certificate as well in case they give you problems - you can show that it is your wife that lives there. Better to have too much with you than not enough! Good luck.

  7. If you are not sending an original document then why are you opposed to a highlighter? I think that’s more efficient then making someone read a legal document just to find your wife’s name. As far as the CC- just throwing it out there- you have already provided USCIS so much stuff over the years including SSN - I wouldn’t be concerned they are going to steal your CC info. But I agree with sending statements that have both of you listed as well as transactions that show the cards are actually used- not just “created” for this purpose. Good luck!

Im just curious on how long the it take you guys to become citizen from the time you submitted your application to the time you had your oath.  I submitted August 2019 & i got my Oath August 20 2021.

Please create your timeline on the site as this will help others and help you! It took exactly 1 year minus a week from the time application was sent.

That policy change was recently rescinded.  USCIS reverted back to their old policy for "agency officers to issue an RFE or NOID when additional evidence could potentially demonstrate eligibility for an immigration benefit." -- https://www.uscis.gov/news/news-releases/uscis-updates-policies-to-improve-immigration-services

Note that this doesn't mean USCIS will now tolerate obvious placeholder submissions.  The policy is meant to give petitioners/applicants "an opportunity to correct innocent mistakes and unintentional omissions."

Thanks. They really should update their policy as this says otherwise and is “current” as of 8/12… https://www.uscis.gov/policy-manual/volume-1-part-e-chapter-6

WOW, a broken system has become even more broken.  INSANE.  We might as well white out the 14th amendment.

LOL! How does that violate your right? Why should USCIS have to hand hold when you forget to sign a form? If you can’t follow instructions -denied- feel free to apply again-that’s what I would do 😆 move the process along faster for those that can follow instructions.

I think you hit the nail on the head with this guy!  Some folks lack the attention to detail to do this stuff themselves and this guy, with his forgetting signatures and not following requests, shows he needs support if/when he applies again.

Yes . This guy should have had a lawyer at the beginning for the stupid mistakes he made. OP- USCIS no longer HAS to send a RFE- they have the option of straight out denying. However it seems it was denied because they haven’t met in two years which is a necessity. We all will just speculate though until he has the denial letter. Moving forward a lawyer will only (most likely) be more thorough than this guy. He’s still going to need to see her again if they proceed with the k1. A lawyer can’t speed it up. But if this guy is this bad with forms it may help for him to hire someone.

In addition to the answers given, I’ll add know thyself. Some people are simply not good with filling forms, gathering information, dotting their “i’s” and crossing their T’s. If you know you’re such a person, a competent immigration attorney will save you the headache.

It really doesn’t matter that many others have done it themselves if you know yourself you lack those traits. There’s a reason we have lawyers, plumbers, electricians, carpet installers, auto mechanics etc while some people are able to do such tasks themselves.

    All the best.

PS: If you make a million dollars a year 😊, it just might not be worth your time in dollar terms to spend hours on the application.

You make a good point. Some people would be better off with a lawyer depending not just on the case itself but on the individual.

This is a very simple question, I think.  What is the meaning of the term "Immigration Proceedings" as it appears in the question in the I-130 form: "Was the Beneficiary ever in immigration proceedings?  My wife, previously, had a green card but voluntarily gave it up.  Now we want to get her one again and, eventually, a passport.  Is previous green card process "Immigration Proceedings"?

No... Unless she went before a judge because of potential deportations and that is why she voluntarily gave it up.

Even though the situation is tough in Haiti, there are many beautiful places in Haiti. In fact, there are some people in Haiti who are living better than the majority of people in the US. If someone has the means, living in Haiti is not a bad place. I would probably try to stay away from Port-au-prince as much as possible.

Yes, definitely! Unfortunately no one we know lives *that* well as family is in PAP. But we love the outskirts of Jacmel.-not so much the ride through the mountains though. Visited Port Salut once and that was beautiful would love to go back. Spent a little bit of time up north and the outskirts of Cap Haitian were beautiful as well. I just wish there wasn't so much suffering in the country.

Hurricanes and earthquakes are in almost country. That is not necessarily the problem for Haiti. The problem is its infrastructure. It is not prepared.

Japan has thousands of earthquakes every year but they are prepared. The housing, for the most part, is earthquake resistant.

I wouldn't say earthquakes and hurricane are in almost every country but yes, you are correct, there are many issues that make these natural disasters even worse in Haiti than other places. TOO many issues to make a complete list; use of charcoal and loss of natural forest/ground cover, corrupt government with little to no oversights, lack of affordable good education, lack of clean water access, electricity, lack of sanitation, poor roads, no building codes etc I'm sure you know the list just goes on. The people end up being the ones to suffer though without all these. For many of us our families will never get the opportunity to leave (even for visits) and see what life could be like elsewhere.

Hello, we are filling our I-134 and we need some help.
1- Does my fiance (petitioner) need to list me (beneficiary) under Dependent's Information? He doesn't claim any dependent on hist tax return. But I read someone that the beneficiary should be listed there. No, You are not a dependent, you are not married; even if you were you would not be a dependent.
2- We have a co-sponsor does she need to send proof of U.S citizenship? If so what would that be? I don't think that is needed ; instructions for the I-134 form are here https://www.uscis.gov/sites/default/files/document/forms/i-134instr.pdf but if you did need the following are proof of US citizenship; US birth certificate, passport face page or naturalization certificate
3- Our co-sponsor is married does her husband need to sign the I-134 as well? No
4- For the I-134 filled by the Co-sponsor. In Part 2 Information about the beneficiary, item 7. Relationship to Sponsor. Does that remains fiancee or we should put the beneficiary's relationship to the Co-sponsor?  Would that be friend's fiancee ? Because the petitioner is a friend of the co-sponsor. I would suggest friends fiance- as you are not the fiance of the co-sponsor

    Good luck.

  17. Hi All, I wanted to reach out to make sure everyone's family/loved one is safe after the earthquake and hurricane last weekend. I meant to make this post earlier. We have family in Les Cayes who lost their homes but thankfully they are all right. I hope everyone is safe and accounted for and wish a speedy visa process for those who are waiting!! Poor Haiti never catches a break.
