  1. I simply meant that you fill out the form as accurately and thoroughly as possible. I didn't say you upload anything. I should have been more clear. My apologies.
  2. As much documentation as possible should be provided when filing the application. Most decisions are already made BEFORE the interview. If a person has sufficient evidence to prove they will not overstay, they stand a shot at getting a visa. If you can't prove it, your not getting it... Think of it as everyone is automatically refused until they can change the CO's mind. Honestly, (in my opinion only), I feel that having a child in the US is a negative more than a plus when it comes to getting a tourist visa approved.
  3. I know of at least 2 towns in NY where clerks were asking to see visa stamps (this was back in 2017). Whether it was legal or not, I cannot say.
  4. I see that you are in Florida, and for the sake of this post I will assume your fiend is as well. They should look into what the requirements are for a license in THEIR county. Some jurisdictions may require proof of legal status. If this is the case, they should look for a "blue" county either in their state or another state which is more friendly.

I know you said that you do not intend to stay in the US with your C1D, and others have reminded you that you are ineligible to adjust status with that visa, but I will reiterate: Please, please, please, do not overstay in the US on your C1D. My wife made this mistake, and it has caused nothing but issues and very long delays for our journey.
  6. This likely made you ineligible for a K1. The unofficial marriage and age difference will be huge obstacles to overcome. Marry and go the CR1/IR1 route.
  7. Thank you for clarifying. As others have said, STOP referring to her as your wife. If you do, this will cause many issues down the road. Have you had any formal engagement ceremonies? If yes, please describe them. I ask, because often, US immigration will consider certain types of engagement ceremonies as a marriage and will not allow you to pursue a K-1 visa. It may be a much better plan to marry now and go for a CR1/IR1 visa.
  8. Are you already married? If so, you will be doing a CR1/IR1 visa, not a K1.
  9. That "our story" is from 2006. I would imagine he is either looking to bring her kids here now, or this is a new person he is applying for.
  10. I did not say we requested the letter to state that I or my wife is required to take care of him. I said we requested a letter stating his diagnosis.
  11. My father and my mother (his POA) are the ones who requested it. The doctor will give them the medical records but is refusing to write a letter addressed to USCIS even though my father is requesting it (he has full mental faculties, just suffers from shaking and other physical symptoms)
  12. Like I said, this is the weakest argument and is just one bullet point of many. The relation is the extreme hardship to me if I had to leave my father while in his condition or have my wife and son go alone. Yep, at this point, it's 3+ years... but it's 601a or nothing Thank you. That's what I thought.
  13. Lawyer said just to write it in the letter. This is one of our weakest arguments anyway, my lack of Thai language, inability to work there and affect of relocating our son without me (if I were to stay here) are our big ticket items which should already guarantee approval. My dad's health concerns is just the cherry on top (in a morbid kind of way).
  14. One of the arguments I am planning on using for my wife's 601a waiver is related to my father's health. My father is in his 80's and has Parkinson's. I/we spend a good amount of the weekend at my parent's house helping to take care of him. I would not be able to do this if I were to move to Thailand while we wait out her 10 year bar. My parents have asked his neurologist for a letter stating his diagnosis, but she says she cannot provide it due to HIPA regulations. (I don't believe this is accurate, but that's a different story...) Is it acceptable to just mention my father's condition without providing evidence to support it, or should I just leave it out of the letter entirely? Alternatively, my parents could ask for his medical records and include the entire file (though I would rather not do that route)
  15. When you say unable to travel, do you mean unable to travel to the US, or unable to get to BKK?
  16. I would think that as long as the pictures are clear enough in B&W there would be no problem. Nothing else I can think of that would NEED to be in color.

  19. I don't know... it seems some people are overthinking this... This past September my son and I were in Thailand for him to meet his grandparents. We flew over with 3 large luggages of clothes for my inlaws and toys/snacks to donate to the school in my wife's town (total value +/- $800). We flew home with a luggage full of food and beauty products for my wife and her friends (total value +/- $300). I was not asked to declare anything on arrival to either country, and if I was, I would have put in about as much description to my answer as I did above.
