We just receive k1 approval on 7/25/14,
My current annual income is $18200 from 2007 to present according to my w2.
I would like to ask my employer to increse my annual income to $20800. Will they question about this when my fiancee in the interview ?
One more question is i have two pay check every month, each $700 dollars, 700 x 2 x 12 = $16800. Why i have one more month pay? My previous w2 all show i earn 18200 each year.
is that becasue of this? http://salongacenter.org/2013/03/what-is-the-13th-month-pay/
Pls help. Thanks.

While they look at the totality of your financial situation, the most important thing is your current annual income. If you are not self-employed, then you prove your current income with a letter from employer and/or pay stubs. If you are self-employed, then you use your Total Income from line 22 of your most recent return(2013 currently). You can also show bank statements and quarterly profit/loss statements, if you have those.
So, if your current annual income actually is $16,800, then for a household of 2, you are short $2862. You should be able to list your savings, stocks and bonds and provide proof of ownership and value and still not need a co-sponsor. The decision will be entirely up to the CO that interviews you though.
If you do decide to provide a co-sponsor, then they fill out their own I-134 and provide the same documents, most recent tax transcript, letter from employer and/or recent pay stubs. They should also provide proof of being a USC or LPR.
Thank you for your reply. I made a mistake. My annual income actullay is $18200 accourding to my W2 and tax return transcript. I can provide three years w2 and tax return transcript. So i short $ 1462.
My stock value $49000, i think it will be ok.

You are about $400 short, so do you have about $2k in assets? If so, list them on the affidavit and provide banks statements to prove it. Go back at least 6 months, if not 12.
Yes, it is a true. If you only own one car, then it cannot be used as an asset.
MY total income 2012 is $33000 with stock dividend.
2013 is only $15200 with stock lost
my annual income is $16800 (from 2009-present)
deposit in saving bank $5000
stock and bonds $49336
Do you think i need a co-sponsor? If i do, I need to prepare i864? Thx
-
Ok. Good! Would your parents be willing to co-sponsor you? It might be a good idea to get that started as soon as possible...just in case. The last think you'll want is to have your future bride turned down at the interview...
Seems that the CO's at the Embassy look at the "bottom line!" If they question it...BAM! 221(g) - refusal of visa - until they get additional paperwork...
So...look into it a bit more...cover yourself...be prepared...
Yep, they willing to. Thanks for your reply.
-
I can't remember where, but I would've sworn I remembered reading somewhere that only vehicles after your first one could be counted as assets. In other words, if you just have one car, you can't count that as an asset.
Does this ring a bell with anybody else, or am I just going crazy?
is this true..

You live in NY NY???? At your income, you must be living in a shoebox? Are you living with others? Family? Friends? Co-workers? Roommates? That could come into play? Others might disagree with me...but, embassy personnel are not ignorant. Just sayin'. Again, you are at the edge financially...
Perhaps others who have been in your situation can add something to this...
I am living with my parents. They all got jobs. I living in manhattan, chinatown. city affordable house

http://travel.state.gov/content/visas/english/immigrate/types/family/fiance-k-1.html#8 Proof of Financial Support and Affidavit of Support Forms
During the visa interview, applicants will be required to present evidence to the consular officer that they will not become a public charge in the United States. You may present evidence that you are able to financially support yourself or that your U.S. citizen fiancé(e) is able to provide support. The Consular Officer may request that a Form I-134, Affidavit of Support be submitted by the U.S. citizen fiancé(e).
The U.S. citizen fiancé(e) will need to submit Form I-864 to USCIS with the application for adjustment of status to that of legal permanent resident following the marriage.
Do the Same Income Requirements Apply to Form I-134 as Apply to Form I-864?No. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.
http://www.uscis.gov/sites/default/files/files/form/i-864p.pdf 2014 poverty guidelines
I am the applicant, so i only need to show them that my income is 100 precent of the federal poverty guideline? which is only $15730.
Please help Thx.

Officially 6 months since i filed my petition & USCIS still won't let me do an e-request because apparently it is within processing time.
Also waiting on answer from Gillibrand.
This is the most frustrating process of my life thus far.
do the way i did, made the submit date as dec 3 (you can try later since now they work on dec17), the e-request will go through.
i receive approval after 10 days of they response my e-request.

I'm only a May filer, but trust me I have been keeping an eye on everyones situation hoping that it will get better.
The thing is, do we even know why TSC is so backlogged? It can't be the usual "ebb and flow", something just doesn't seem right about the severe lack of applications they are even getting through.
Do you think there is some type of report employees or USCIS have to fill out at the end of each month (like work status, who worked on what, how many people actually did k1 applications)? Perhaps something that can be requested via the FOIA to at least give us some clarity on the inner workings and what is actually going on.
I too was thinking of tweeting USCIS, if only the new director guy had a twitter, we could storm social media if only to gain some attention to our problems!
I have already @ him..

at least you got something , and at least you could put a service request. we are 6 months from noa 1 and we still can not make a service request ...
you can make servic request, just put your filing day to december. I put mine 12/03/14 and it went through.

You're New York. Call Sen. Gillibrand. They will help you @ 5months. GO here http://www.gillibrand.senate.gov/services/casework/ and fill out the Immigration Privacy Release form and fax it in. Her office was so helpful to me and was super responsive!
I am in NY also. Thanks for you information.
-
I believe i have to wait more time.
i dont mind to wait one more month but please just give us all approval
-
Hello. I too have 5 months and 1 week of waiting. I put through both a service request as well as a Senator inquiry. The latter said to wait six months before calling his office which will be in three weeks time. THEN they will do an inquiry. This is really very upsetting.
which letter? from senator? I am in ny also. what is the name of your senator
-
This is what I did and I got my approval as well. I just put in 12/01/13 as the recieve date in on my e-request on 6/22, and got my NOA2 yesterday 6/30.
Thanks, I just try it. Hope it works.
