Hmm, there was no political violence when the 2020 results were finally revealed. Sure the Jan. 6 rally got a bit out of hand, but otherwise were peaceful, Trump actually did leave the WH. Now in 2016, I remember riots and political violence happening in many places. So which side are they preparing for?

I-751 and N-400 without interview?
Dashinka replied to MikeSchw's topic in US Citizenship General Discussion
Hard to say, but the overall recommendation is if you are scheduled for an N400 interview with an I751 pending, assume it will be a combo interview and have you spouse go with you. Even if the IO does not conduct an I751 interview, it doesn’t hurt to mention that your spouse is with you, and supporting you for your N400 especially when applying based on marriage. I remember in our case, my wife applied for naturalization based on marriage with our I751 pending. She was called for an N400 interview with no mention of the I751, but I went with her regardless. The IO invited me back for a brief I751 interview where the IO had our fairly extensive I751 package in front of her. The IO asked a few questions about our marriage (nothing like a Stokes separate interview), and reviewed the I751 form, then asked if we wanted to add any additional evidence, so we gave her our latest joint tax filing information. Then I was escorted to the waiting area, and my wife continued with the N400 alone. It was fairly easy and took about 15-20 minutes total. Of course YMMV as not all offices or IO’s are the same (ours was pre-Covid), but if you have a bonafide marriage, and your I751 package is complete with plenty of marital evidence, I would not fret. Just keep preparing for the civics test, and you should be fine. Good Luck! -
Definitely the loss of a music icon. R.I.P. Mr. Jones. Quincy Jones, music titan who worked with everyone from Frank Sinatra to Michael Jackson, dies at 91 Quincy Jones, the multitalented music titan whose vast legacy ranged from producing Michael Jackson’s historic “Thriller” album to writing prize-winning film and television scores and collaborating with Frank Sinatra, Ray Charles and hundreds of other recording artists, has died at 91. Jones’ publicist, Arnold Robinson, says he died Sunday night at his home in the Bel Air section of Los Angeles, surrounded by his family. Jones was to have received an honorary Academy Award later this month. https://apnews.com/article/quincy-jones-dead-a9e31c7e39c448d8971519f47a22dd21

So sorry you are going through this. As already stated a divorce waiver tends to be easier relative to the I751, but there was a recent discussion about pursuing an abuse waiver. I posted the beginning of that discussion here, you may try PMing the member there and see how your situation is similar and different. Good Luck, and Stay Safe!

Daily Update on Kamala Tanking America
Dashinka replied to Boiler's topic in Current Events and Hot Social Topics
Does this surprise anyone? New REPORT Shows Kamala Used TAX DOLLARS to Pay U.N. Officials to Help Illegals 'Break Into' America Well well well, WHAT do we have here? A new report from the House Judiciary showing Biden/Harris spent over 81 MILLION of our tax dollars to advise other 'foreign nationals' on the easiest way to migrate to the United States. At least $81.7 million in U.S. taxpayer funding spent by the open-borders United Nations to allow illegal aliens to bypass the southwest border and fly directly into the United States. Migration centers set up throughout Central and South America staffed by U.N. bureaucrats. Nearly 70,000 aliens referred for potential resettlement in the United States. https://twitchy.com/samj/2024/11/04/house-judiciary-kamala-migrant-alliance-n2403213 -
If you are currently in the US, your USC spouse can file the I130 and I485 along with all the required evidence and support forms (I864, I765, I131) for you to adjust status. Good Luck!

It sounds like the girlfriend is the USC and potential future petitioner.

Honestly you can do whatever you want. The concerns I brought up and were echoed by @nastra30 are related to how things may look to a consulate officer in many countries. This is often related to the levels of immigration fraud committed in those countries, and experience and stories of others that have gone before you (the beauty of VJ). So you will already face a higher burden to prove the relationship is bonafide when it comes time for a visa interview. We are not here to judge your relationship, but to help you understand the hurdles ahead and try to help you lower them as much as possible. Go and meet, and if things turn out great and there are no big red flags, keep communicating, plan additional visits, and at some point as the relationship grows, get married, and then visit more while your I130 petition is processing. Good Luck!

Moving Back to US with My Daughter
Dashinka replied to Srene's topic in Bringing Family Members of US Citizens to America
In that case you may want to re-word a letter and both of you sign it and have it notarized that he is in agreement with this plan, and you agree to allowing her to visit. Beyond that, maybe consult with a lawyer as to how to structure an agreement. Since you are still legally married with no plans to divorce, I am not sure what else you can do as this really doesn’t deal with legal custody, and who knows, she may not like the experience of living in the US, and want to go back after some time. Good Luck! -
Are you planning to get married on this visit? Marriage on first visits can lead to questions by the consulates when visa interviews come up, so if you do get married on this visit, plan to make more visits while the petition is processing, and growing the marriage as much as possible. Good Luck!

Moving Back to US with My Daughter
Dashinka replied to Srene's topic in Bringing Family Members of US Citizens to America
I found this which may be helpful. Providing parental consent when a child travels without both custodial parents Ports of entry in many countries have security measures to prevent international child abduction. If your child is traveling alone or with only one parent or legal guardian, they may need a letter of consent from the other custodial parent. The letter of consent, preferably in English and notarized, from the other parent (if the child is traveling with one custodial parent) or signed by both parents (if the child is traveling with a guardian or alone) should say: "I acknowledge that my child is traveling outside the country with [the name of the adult] with my permission." https://www.usa.gov/travel-documents-children -
Moving Back to US with My Daughter
Dashinka replied to Srene's topic in Bringing Family Members of US Citizens to America
This ^^^^ To the OP. I know some friends that have made trips into Canada with their children, but without their spouse (the other parent), and they always take a notarized letter. As @EmilyW stated, CBP or the Canadian equivalent do not always ask for it, but they always have it with them. If your spouse is agreeable, go this route. Good Luck! -
Hmm, a pretty good analysis. I loved the part where the US government would question late results in other countries, but are just fine here. Is Trump right to fear election fraud? Cheating has never looked easier Federal and state officials appear determined to validate voters’ fears. California recently passed a law preventing local governments from requiring voters to present identification in order to vote. The Department of Justice has filed suits against the states of Alabama and Virginia to keep them from purging ineligible voters, including non-citizens, from its voter rolls. Investigations are underway in Pennsylvania where two counties are reporting evidence of large-scale voter registration fraud. And, according to Michigan officials, there is a “nationwide issue” with voting terminals preventing voters from making certain selections on their ballots. It seems that, as in 2020, the 2024 election will stretch out past election day. Officials from key battleground states, including Arizona, Georgia, Michigan, North Carolina and Pennsylvania, have already warned of delays in announcing results. Fox News Channel’s Decision Desk anticipates at least a four-day delay before it makes a final call. To mollify, or mislead, voters, Pennsylvania’s Department of State posted on X that “Pennsylvanians won’t always know the final results of all races on election night. Any changes in results that occur as counties continue to count ballots are not evidence that an election is ‘rigged’.” But delaying the announcement of election results is typically seen the world over as evidence of fraud. US officials once saw it that way, too, at least up until the 2020 election when contesting election results became grounds for indicting Trump, his lawyers, and other top aides. For instance, delays in announcing the results of the first round of Peru’s 2000 election — which included three days for the presidential race, more than a month for congressional contests, and a “mysterious” lapse in the transport of ballot boxes to vote count centres — caught the Clinton administration’s attention. A State Department spokesman warned the Peruvian government “to take every possible measure to ensure that the next round of voting fully meets democratic standards of openness, transparency and fairness”. https://unherd.com/2024/11/is-trump-right-to-fear-election-fraud/

VDH is absolutely right, and I have been saying this for some time. If a Democrat is labeling their political rival with some form of negative label, fascist, racist, sexist, etc., you can make bank on the fact that it is in fact the Democrats that are actually more accurately described by those labels. Once Joyful Harris Now Goes the Full McCarthyite Recall that fascists hijack law enforcement and the military to suspend constitutional rights and punish enemies. But Trump did neither. Instead, in 2016, a corrupt FBI went after Trump himself during the Obama administration with the bogus Steele dossier. The FBI, which in 2016 had hired the faker Steele, in 2020, fused with social media to suppress accurate news reporting of the embarrassing Hunter Biden laptop scandal. https://amgreatness.com/2024/10/31/once-joyful-harris-now-goes-the-full-mccarthyite/

USCIS could have detected something related to the quality of the biometrics, or a problem with the photos taken that are keeping your physical card from being produced etc. Personally I would look at calling USCIS and trying to get a response from a Tier 2 customer service rep (don't waste your time with the tier 1 person), and see if you can figure out why they are asking for additional biometrics, and see if the appointment can be re-scheduled for after you arrive in March (unless you plan on traveling between now and then to the US). Good Luck!

Engagement ceremony was not a problem
Dashinka replied to DBiddle's topic in K-1 Fiance(e) Visa Process & Procedures
I am not sure anyone said engagement ceremonies are a guaranteed denial for a K1. That being said, there are many stories in many countries where people have been denied for ceremonies that looked too much like a traditional wedding, so the overall recommendation is to avoid the appearance of a wedding as if it is questioned by a difficult CO, it is impossible to defend a negative. Regardless, congratulations on your K1, and good luck with your visa journey! -
Correct. Naturalization would be becoming a USC if you so desire. Honestly it is best if you are doing AOS to become an LPR to make the change then (this is what my wife did), but I brought up naturalization as it is an option in the long run, and many people do it that way to avoid dealing with the name differences on a foreign passport (this is generally not really a big deal). Good Luck!
