  1. I agree with @OldUser, this is definitely not a DIY case. If your lawyer knows now about the previous marriage and is saying you should still be able to adjust, they may know something we don’t know. On the surface it appears this was never a valid marriage, but you did not know this, so a VAWA may be possible. What isn’t clear to me is the timelines involved, so your ex was already married when they petitioned for you (which visa? K1, spousal visa, etc.?) and now they are petitioning for their previous spouse. Are you sure this is not a case of your ex immediately looking for a new spouse after your divorce? Good Luck!

  4. Not having a joint bank account is not a deal breaker. My wife and I have separate accounts although we have access to each other's account, so they are sort of pseudo-joint accounts.
  5. It is hard to say how much weight a school schedule will sway the CO, but they certainly can try. I am not sure if a CO considers if a B2 applicant can AOS, but if they do, your brothers may have a better chance.

  12. My wife was denied twice for a B2 visa and she still got her K1, AOS, ROC and N400 approved. As long as there was no material misrepresentation when filling out the DS160 for the B2 visa you should have no issues. Good Luck!

  15. Yeah, my family there keeps asking me when I am coming to visit as I have not been there since 2019. I probably should have gone with the wife in 2021, but work and Covid stopped that (I know, I could have figured it out). Now, we discussed it and even though my wife is naturalized, she still has her Russian passport, so she went in September, but I stayed in the US. She rarely left the flat the entire five weeks she was there. As an aside, have you heard about the fires in shopping centers in Russia? Moscow of course gets most of the news, but apparently there were two very recently in Krasnoyarsk as well (not sure about other cities).

  17. The N400 application is separate and has it’s own list of required evidence. For submission there is not much needed (reference N400 instructions page 10), unless filing from overseas or as an active military member, you just need to submit a photocopy of your GC and evidence of marital status. There is a bigger list of evidence that is required for the interview (page 11), and many when filing online will upload that information as well, but it is not required.
