  3. The required evidence for submitting the N400 is fairly light (reference the link page 10). Unless you are filing from overseas or the spouse of a military member or in the military yourself, only numbers 2 and 3 apply. There is a longer list of evidence requested for the interview beginning on page 11, and many folks filing online also upload that material, but it is not required to submit an N400 application, and the applicant still needs to bring it to the interview even if they uploaded it. In my wife’s case, she filed by mail, and only included the required evidence, took the rest to the interview where the IO ignored all of it.   6. Are you currently in the US? If not, you just need the I130 and I130A at this point. The I864 comes at the NVC stage after the I130 is approved by NVC and the process moves to the consulate in Canada. Good Luck!
  7. This still has to deal with the major challenge of storing the H2. There are also issues in that an H2 fueled ICE engine does emit some bad stuff, so it might require some interesting exhaust after treatment like diesels do today.

  10. Not necessarily. My wife chose to take my family name, but her Russian passport is still in her maiden name and it caused no issues. Once you get married and get your marriage certificate (a legal name change document recognized in the US), submit the I130 and any supporting documents in the name she wants to have on her visa/GC. She can change her passport later if she wants of it is not too much of a pain like it is in Russia. Good Luck!
  11. In general, the I485 has to be routed to the local field office for an eventual interview. This goes through NBC. As to if it is getting closer, I would say yes, but of course that is dependent on how backed up your local field office is. Good Luck!

  14. They cannot deny a visa just because they want to? How many B2 applications get rejected everyday for little or no reason? As to a WoM, I am not sure anyone is advising the OP not to look at that route. Of course not everyone can afford to take this route, but it seems the OP is strongly considering it. My only issue with this thread and the suggestions is they are based on very little background data. We have no idea why the BIL’s (I think this was the OP’s sister’s spouse) application is being held up in AP. They OP has more information on that, and if they feel they have exhausted all other options and are fine with the legal fees, the WoM is a viable option.

  17. It really depends on the long-term situation. Is it important for your immigrating fiancé to work immediately? Is it important for them to be free to leave the US and re-enter relatively soon after entering the US? Is money an issue? It is a tough decision for you at this point 8 months in, but you have to weigh that against the additional time it will take to do the AOS, get work authorization, get advanced parole, and the added cost of the I485. The spousal visa is far superior to the fiancé visa, but changing it at this point is a personal decision. Good Luck!
